의료행위에 관한 설명·동의 원칙의 제한과 법익의 형량 – 긴급의료와 연명의료를 중심으로

Balance of Interests for Exceptions to Principle of Informed Consent in the Context of Emergency Medical Service and Life-sustaining Medical Care

초록

어떤 의료행위가 실시되기 전에 이에 대하여 의사가 설명하고 환자가 동의 여부를 결정한다는 원칙은 모든 상황에서 지켜져야 하는 것은 아니다. 가령 의료행위가 긴급하게 이루어져야 하는 경우, 환자가 뇌사에 빠져 있는 경우, 의료행위가 강제로 이루어져야 하는 경우, 자살시도환자를 진료해야 하는 경우, 필수적인 의료행위를 거부하는 경우, 환자 측이 설명 들을 권리를 포기하는 경우, 설명이 오히려 의료행위의 효과를 저해하는 경우 등에서 그 예외가 인정된다. 그러한 원칙에 예외가 인정되기 위한 논리로 흔히 등장하는 것이 동의 추정 이론이지만, 이 이론은 예외의 모든 상황에 적용될 수 없다는 점에 착안하여, 법익형량론을 논의하기에 이르렀다. 물론 동의 추정 이론을 폐기하자는 것은 아니고, 이를 법익형량론으로 흡수하여 동의 추정 이론이 부적절한 예외상황도 설명하고자 한 것이다. 이 법익형량론은 두 단계로 이루어진다. 우선 시도하고자 하는 진료의 지연이나 포기가 야기할 수 있는 법익 침해(A)와 그 진료 자체가 야기할 수 있는 법익 침해(B) 사이의 형량에서 전자가 후자보다 커야 한다(A⟩B). 그리고 이 차이가 설명·동의 원칙의 제한이 야기할 법익 침해(C)보다 커야 한다[(A-B)⟩C]. 여기서 법익침해는 그 실현될 침해의 크기(amount)에 그 실현가능성(possibility)을 곱한 것이다. 이 공식을 충족한 행위라면 비난 가능성이 부인된다고 보아야 할 것이다. 설명·동의 원칙이 제한될 수 있는 상황인지의 판단과 그 정당화를 위한 도구로서 법익형량론을 긴급의료 및 연명의료의 상황에 적용한 것이다. 법익형량론을 긴급의료의 상황에 적용한다면 다음과 같다. 의사는 환자의 상태를 진단한 결과 긴급한 상황이므로 그의 재량으로 여러 방법 가운데 하나를 임의로 선택하여 실행할 수 있는지의 판단을 위한 법익형량론은 이렇다. 환자의 상태가 설명·동의의 절차를 통하여 선택할 시간이 있었는지 여부가 우선 판단되어야 한다. 그 시간의 여유가 없는 긴급의 상황이라면 진료 지연이 야기할 법익 침해(A)가 임의로 어느 방법을 선택하여 실행된 진료 자체가 가져올 법익 침해(B)보다 크고, 그 차이가 설명·동의 원칙을 생략한 ‘무단 진료’가 야기하는 정신적 인격법익 침해보다 크다면, 그 방법을 선택하여 실행한 것에 있어서 설명·동의 원칙 침해로 인한 손해배상책임은 부인될 것이다. 법익형량론을 연명의료의 상황에 적용하면 이렇게 될 것이다. 연명장치의 부착 여부이든 그 제거 여부이든 의학적 무의미성 내지 회생 불가능이라는 객관적 요건이 구비된 경우라면 환자 본인의 가치관이 ‘부착’ 또는 ‘제거’를 위한 ‘(A-B)⟩C’ 요건의 구비 여부에 결정적인 역할을 한다. 연명의료를 거부하는 가치관을 가진 환자라면 ‘부착’을 위한 ‘(A-B)⟩C’ 요건은 성립되지 않으므로 임의로 부착해서는 안 되고, ‘제거’를 위한 ‘(A-B)⟩C’ 요건도 구비된다고 보아야 할 것이다.

Abstract

There are situations in which we may not stick to the informed consent rule that a physician inform a patient of the matters material to decision by the patient to choose and undergo a medical treatment. Such situations include cases of emergency medical service, brain death, legal infectious diseases, attempted suicide, necessary medical service, relinquishment of rights to be informed, information harmful to the patient (therapeutic privilege) and so on. In these cases, the physician is free from the duty to disclose. The most acceptable ground for some exceptions to the rule is presumed consent. However, presumed consent can not serve as the ground for all cases of such exceptions. Therefore, I suggest the theory of balance of interests. According to the theory of balance, the interests related with a medical treatment and informed consent should be balanced against the disadvantages. The theory of balance is not intended to deny the usefulness of the theory of presumed consent or to supersede the latter. The theory of presumed consent is still a very good basis for some of the exceptions to the informed consent rule. Any medical treatment can be permitted to be carried out even without informed consent, provided that the balance indicates so. For the sake of convenience, let us establish that “A” is the amount and possibility of infringement of legal interest caused by the delay or abandonment of medical service during the informed consent. “B” is the amount and possibility of infringement of legal interest caused by the medical service recommended or chosen by the physician, while “C” is the amount and possibility of infringement of right of self-determination caused by the ommission of the process of informed consent. Therefore, the exception to the informed consent rule can only be allowed in the case of “(A-B)>C”. In this paper, the above formula is applied to two exceptions for emergency medical service and life-sustaining medical care. The following is the formula of balance theory applied to emergency medical service. When a physician finds that the patient is in a situation in need of emergency medical service, he or she should confirm whether he/she will acquire informed consent from the patient, or from the other person who has a power of determination about the medical service. The formula of the balance theory indicates that "B" and "C" in the formula are critical to the determination related with the life-sustaining medical care, because “B” and “C” depends on the patient's intention of refusal against attaching life-sustaining apparatuses. Therefore, it is not only unnecessary but also prohibited to attach the life-sustaining apparatus to the patient whose confirmed intention is to refuse the life-sustaining medical care through his/her actual or presumed intention, living will, or family or close acquaintances. Moreover, any physician should detach the life-sustaining apparatuses attached to a patient when the physician discovers that the patient’s intention is to refuse life-sustaining medical care.
