온라인서비스제공자에 대한 책임제한 조항의 성격 및 요건(대상판결: 대법원 2013. 9. 26. 선고 2011도1435 판결)

웹스토리지서비스(웹하드서비스) 등을 제공하는 온라인서비스제공자의 저작권 침해 책임과 관련하여, 구 저작권법(2008. 2. 29. 법률 제8852호로 개정되기 전의 것)은 일정한 경우에 온라인서비스제공자의 책임을 감경 또는 면제하는 책임제한 조항을 두고 있다. 즉 구 저작권법은 제102조 제1항에서 ‘온라인서비스제공자가 저작물의 복제·전송과 관련된 서비스를 제공하는 것과 관련하여 다른 사람에 의한 저작물의 복제·전송으로 인하여 그 저작권이 침해된다는 사실을 알고 당해 복제·전송을 방지하거나 중단시킨 경우에는 다른 사람에 의한 저작권의 침해에 관한 온라인서비스제공자의 책임을 감경 또는 면제할 수 있다’고 규정하고, 같은 조 제2항에서 ‘온라인서비스제공자가 저작물의 복제·전송과 관련된 서비스를 제공하는 것과 관련하여 다른 사람에 의한 저작물의 복제·전송으로 인하여 그 저작권이 침해된다는 사실을 알고 당해 복제·전송을 방지하거나 중단시키고자 하였으나 기술적으로 불가능한 경우에는 그 다른 사람에 의한 저작권의 침해에 관한 온라인서비스제공자의 책임은 면제된다’고 규정하고, 같은 법 제103조 제5항에서 ‘온라인서비스제공자가 저작권자로부터 불법 저작물의 복제·전송을 중단시킬 것을 요구받고 즉시 그 저작물의 복제·전송을 중단시킨 경우에는 온라인서비스제공자의 책임을 감경 또는 면제할 수 있다’고 규정하고 있다. 여기서 위 각 책임제한 조항이 민사책임뿐만 아니라 형사책임에도 적용되는지 여부가 문제 되는데, 대상판결은 책임제한 조항이 형사책임에도 적용된다는 점을 최초로 명시적으로 밝혔다. 한편 그 책임제한 요건과 관련하여서는 두 가지 점을 명확히 하였다. 첫째, 구 저작권법 제103조 제5항의 경우에는 저작권 침해 등에 대한 중단요구를 받고 ‘즉시’ 중단시킬 것을 요구하는 데 반하여 제102조 제1항의 경우에는 아무런 규정이 없으나, 권리자의 요구로 비로소 저작권 침해사실을 안 경우에도 즉시 중단조치가 요구되는 이상, 스스로 침해사실을 인식하게 된 제102조 제1항의 경우에도 ‘즉시’ 중단조치를 취하는 것이 당연히 요구되는 것으로 하였다. 둘째, 구 저작권법 제102조 제2항에서 규정하고 있는 ‘기술적으로 불가능한 경우’는, 온라인서비스제공자가 이용자들의 행위 중 저작재산권 등의 침해 부분을 구별하여 이를 제지하는 것이 기술적으로 불가능한 경우를 의미하는 것으로 하였다. 기술적 불가능성의 판단 기준에 관하여는 특정한 기술을 일반적 판단 기준으로 선언하는 것보다는 관련 기술의 진전에 따라 사례별로 판단함이 타당하다고 생각된다. 구 저작권법의 책임제한 조항은 2011. 6. 30. 모두 개정되어 제102조 제1항 및 제2항은 ‘책임을 지지 아니한다’는 문구로, 제103조 제5항은 ‘책임을 면제한다’는 문구로 각 개정되었다. 대상판례의 취지가 개정된 저작권법 아래에서 발생하는 유사 사례에 어떻게 적용될 것인지 여부가 앞으로 더욱 주목된다.

Abstract

In relation to the obligation of online service providers providing web storage service (webhard service) etc., the former Copyright Act (amended by Act No. 8852, Feb. 29, 2008) provided that the provider's obligation is reduced or exempted under certain circumstances. Specifically, Article 102(1) of the former Copyright Act provides that “in a case where an online service provider prevented or halted a copy and transfer service upon realizing that the copied or transferred content's copyright is infringed by another person copying or transferring the content, the service provider's obligation regarding copyright infringement by another person is reduced or exempted.” Article 102(2) of the same Act provides that “in a case where an online service provider providing copy and transfer service for copyright content realized that a content's copyright was infringed by another person copying or transferring the content, and attempted to prevent or halt the process but failed to do so due to technical impossibilities, the service provider's obligation regarding copyright infringement by another person should be exempted.” The issue here is whether the aforementioned exemption Articles are applicable to not just civil obligation but also criminal obligation, and the subject case was the first to explicitly announce that the exemptions are applicable to criminal obligation as well. The subject case clarified two points regarding conditions for exemption. Firstly, while Article 103(5) of the former Copyright Act requires “immediate” suspension upon request for suspension against copyright infringement, etc., Article 102(1) does not have such provisions. However, since immediate suspension is required even when the copyright infringement came into light through the copyright owner's request, the subject case determined that “immediate” measure of suspension is required when the provider itself became aware of the infringement as in Article 102(1). Secondly, “technical impossibility” as provided by Article 102(2) of the former Copyright Act was defined as a case where it is impossible for an online service provider to distinguish and halt the copyright infringement portion of its users' activities. Regarding the standard for determining technical impossibility, individual determination of each case depending on the development of related technology is more appropriate than announcing certain technologies as the general standard. All exemption Articles of the former Copyright Act were amended on Jun. 30, 2011; the wordings on Article 102(1) and (2) were amended as “do not take responsibility” while Article 103(5) was amended as “obligation is exempted.” IT will be interesting to examine how the purpose of the subject case will be applied to similar cases under the amended Copyright Act.
