일본 행정사건소송법상 의무이행소송― 의무이행소송의 유형 구분을 중심으로 ―

초록
신속하고 실질적인 권익구제를 도모한다는 목적 아래, 국민의 권익구제 확대를 위한 소송제도 개선, 사전권리구제절차 정비 등의 차원에서 2013. 3. 20. 행정소송법 개정안이 입법예고 되었다. 개정안은 여러 부분에서 개선된 소송제도 등을 포함하고 있는데, 이 중에서 그동안 판례에 의해서 부정되어 왔던 의무이행소송을 명시적으로 도입하였다. 의무이행소송은 독일, 일본 등 이미 외국에서 시행되고 있는 바, 우리나라 의무이행소송의 정립을 위하여 비교법적 검토의 필요성이 크다고 볼 수 있다. 본고는 일본의 의무이행소송을 주된 비교 대상으로 하되 의무이행소송의 유형에 집중하여 논의를 하고자 한다. 일본은 다른 나라와 달리 의무이행소송의 유형을 신청형과 직접형으로 구분하고 있다. 이러한 유형 구분의 타당성에 대하여 개정 당시뿐만 아니라 현재까지도 논의되고 있다. 이러한 논의를 바탕으로 유형 구분을 별도로 하지 않는 우리나라 의무이행소송과의 차이점 특히 직접형에 해당하는 사례에 대한 권리구제 공백의 문제점을 살펴보고자 한다. 최근까지 일본에서의 논의상황을 고찰하고 그 시사점을 모색함으로써 향후 우리의 법과 현실에 맞는 한국식 의무이행소송 제도가 정립될 수 있음을 기대한다.
Abstract
In pursuit of the swift and practical relief of rights on 2003 May 20 the bill of Administrative Litigation Law was preannounced for improvement of lawsuit system and advance procedure for relief of rights. That introduced the Mandamus Action explicitly that had never been accepted by the court before then. The comparative review is said to need to establish the systemized the Mandamus Action in Korea. The central part of discussion is going to concentrate of the types of the Mandamus Action considering the Mandamus Action in Japan as main comparison. In Japan the types of the Mandamus Action have been classified into the request needed and the non-request needed different from other countries. The relevance of classification like this has been controversial until now. Korea doesn't recognize the non-request needed so there are some questions about the lack of relief of rights. So I have intention to take it into consideration. Actually I hope it can lead to the establishment of the Mandamus Action suitable for the legal reality in Korea.
