미국 연방대법원의 로 클럭(Law Clerk) 제도

초록
연방대법원에는 연방대법관들의 사법심리와 연구를 보조하기 위하여 로 클럭(Law Clerk)이라고 하는 독특한 사법보조인 제도를 두고 있다. 연방대법원의 로 클럭 제도의 기원은 연방대법관의 업무부담을 경감시켜주기 위한 단순한 업무의 보조 기능으로부터 시작되었다. 하지만 오늘날 연방대법원의 로 클럭 제도는 단순히 연방대법관들의 업무 부담을 경감시켜 주는 제도가 아니라 연방대법원의 사법심리과정에서 없어서는 안 될 중요한 역할을 담당하고 있다. 오늘날 연방대법원이 일반적인 상고법원과는 다른 특별한 역할을 수행하는 법원으로서의 독특한 특성을 가지게 있다. 로 클럭 제도는 미국 사법체계 전반에 널리 받아들여지고 있는 제도이다. 연방대법원의 로 클럭은 오늘날 연방대법원이 담당하는 특수한 역할로 인하여 다른 법원의 로 클럭과는 구별되는 기능을 담당하게 된다. 로 클럭은 원칙적으로 연방대법원에 고용되는 것이 아니라 연방대법관에게 고용되는 것이다. 그리하여 그 업무 역시 재판부 전체를 위한 업무가 아니라 자신을 고용한, 그리하여 자신이 소속되어 있는 연방대법관을 위한 업무를 담당하고 있다. 연방대법원의 로 클럭이 담당하는 중요한 업무는 사건선별심리 과정에서의 사건선별을 위한 사건연구 업무 및 보고서 작성, 선별된 사건에 대한 정식 사법심사과정에서의 사건연구 업무 및 그 보고서(bench memo.) 작성, 판결문 초안의 작성 업무 등이다. 로 클럭들은 이들 업무를 수행하는 과정에서 연방대법관들과 긴밀하게 협력함으로써 연방대법원 판단과정에서의 필수불가결한 조력자로서 기능하고 있다.
Abstract
The U.S. Supreme Court is the most credible and influencing judicial institution in the world as well as in the United States. It has developed many effective system which enhance the discussions among the decision makers and many participants. The Law Clerk system of the Court is one of them. The Court exercises special role different from other judicial institutions, since it focuses on protection of the Constitution and the integrity of the federal law. The law clerks of the Court has special role from the other law clerks of the other courts. The law clerks are employed by the Justices themselves, not by the Court. They work for their Justices, not for the Court. Each Justice employ 4 law clerks and they cooperate each other. As one team Justice holds discussion sessions and many other unofficial tea time. These opportunities enhance the understanding the philosophy and value judgement of the Justice. Law clerks should help the Justices not to make conflicting decisions from previous judgments. The major missions of the law clerks are writing and reporting the certiorari memo, bench memo and drafting the opinion.
