군인 성범죄예방을 위한 보안처분제도의 문제점과 그 개선방안

초록
현역 군인인 성폭력범죄 피고인에게 집행유예를 선고하는 경우 보호관찰 등에 관한법률 제56조가 정한 군법 적용대상자에 대한 특례규정상 보호관찰을 받을 것을 명할수 없어 보호관찰의 부과를 전제로 한 위치추적 전자장치의 부착명령 역시 명할 수없다. 본 논문에서는 보호관찰 중에 있는 사람이 군입대를 하여 성범죄를 저지르거나군인신분에서 성범죄를 저지르고 보호관찰을 선고받는 경우, 첫째, 위치추적 전자장치의 부착명령을 선고받은 군인 성범죄자에 대한 위치추적 장치의 제거여부 등법적ㆍ제도적 문제점 등을 검토하며, 둘째, 사회봉사명령 및 수강명령 등이 선고된경우에 누구에게 어떻게 받을 것인지 여부 등 군인 성범죄자 전반에 대한 보안처분의운영상 문제점 및 개선방안에 대하여 검토하였다. 군인 성범죄로 인한 대민피해를 예방하기 위해서는 엄격한 군기유지를 통한전투태세의 확립도 중요하지만, 미국처럼 군인 성범죄에 대한 처벌규정을 별도로마련하여 군 수사기관이 실무적 지침으로 활용하도록 하는 것이 타당하다고 본다. 군사법원이 보안관찰법상의 특례조항 때문에 군법 적용 대상자에 대하여 보안처분을 선고하지 못함으로써 군인 성범죄가 감소되지 않는다는 면 등을 고려해 볼 때,군사법원이 보안처분을 스스로 내리는 방안과 함께 이를 민간 보호관찰소에 위탁하는방법과 군대 내에서 수강명령의 시행과 사회봉사명령이 가능하도록 법제도와 관련규정의 개정이 필요하다고 본다.
Abstract
As to the increase of sex crimes, such crimes with the offender under the militarylaw are on the rise. Immediate measures must be taken about this matter. However,such measures do not consider the special circumstances of the military and isalmost similar to normal measures. The legislature on subjects under the militarylaw is as follows. Article 56 which is about probation prescribes that the probationlaw is not applied to people conforming to any of the articles of the first clause ofarticle 2 of the law of military court. The first clause of article 64 acts as a specialclause for subjects under the military law in that when subject to community serviceor attendance center order, article 56 is applied. The special circumstance of the military being a subgroup of society and the difficultyof enforcing probation to those under the military law was taken under account in thelegislative process. As a result, quite a few problems will arise in abolishing the specialregulation and applying the probation law on those under the military law. The first clause of article 28, the probation and attachment order of electronicdevices on special offenders, defines that when the court suspends the execution of a sentence and decides probation to those of specific crimes, electronic devices canbe attached within the period of probation to check on the compliance details. Thefourth clause of article 9 states that when the court decides on suspended sentenceor probation it should dismiss the charge of attachment order by ruling. Because thefirst clause of article 12 states that attachment orders be executed by a probationofficer under a prosecutor’s directions, the court can charge for the attachment orderof electronic devices when it suspends the sentence of a specific crime. It may seemlogically appropriate not to order for the implement of position-tracking electronicdevices under the premise of probation since the special regulation prohibits probationto those subject to article 56. However, there has not been much discussion aboutwhether there is a problem of equity with general sex offenders or of how the specialregulation acts when a military sex offender under probation discharges. This research will first look into the legal, institutional problems of removingposition-tracking devices from soldiers, those who are under probation joining thearmy or those who have committed sex crimes as a soldier and are under probation,sentenced to position-tracking electronic devices. It will secondly look at thetroubles and measures that can be taken in the management of probation on militarysex offenders. Furthermore, there will be a comparison with other country’sprobation for better understanding. Followed by the concept, method, effectiveness,and legitimacy of electronic surveillance therefore displaying how it can beintroduced to Korea. With such general opinions as a premise, the necessity ofprobation on soldiers and the method of how it will be enforced were researched.
