조선시대의 형법사상과 통제에 관한 연구: 조선 후기 정약용의 형정사상을 중심으로

초록
이 연구의 목적은 조선 시대의 형법사상을 살펴보고 형법체계나, 유형 그리고 통제 등을 연구하고자 한다. 조선시대 형사정책관을 고찰하고 당시의 과학수사는 어떻게 처리하고 징치하였는지 고찰하는 것은 오늘날 한국형법사상의 원류를 추론하고 정책방향을 연구하는 것도 의미가 있다고 본다. 본 연구는 조선 후기 영정조시대의 형사판례집인 흠흠신서, 추관지, 심리록을 중심으로 연구하고자 한다. 조선전기는 중국의 대명률을 계수하여 독자적인 형법체계가 잡혀 있지 않았고 중기 또한 임진왜란이나 병자호란 등 전란으로 인하여 각종 문서나 자료가 소실되었기에 조선 후기로 연구범위를 잡았다. 조선 정조 영조시대에는 형법체계가가 잘 운영되고 있었고 이 당시 발생했던 각종 범죄도 목민관들이 사건에 직접 개입하여 취조하고 수사하였으므로 이 당시의 범죄유형과 사례를 고찰하는데 유용하리라 생각된다. 그러나 조선시대 전반적인 형법사상이 경국대전이나 중국의 대명률을 계수하였으므로 이를 중심으로 형정원칙이나 형정사상을 분석하고 고찰하는 것도 중요하다. 따라서 본 연구는 조선 후기 발생한 여러 형사사건의 범죄유형을 고찰하고 이를 통제하는 형법시스템은 당시의 형사판례집을 중심으로 연구하고자 하며 유교적 형정사상을 조선왕조실록, 경국대전 등을 살펴보고자 한다. 이를 위해 인본주의적 형정사상, 흠휼사상의 논리를 추적하고자 한다. 본 연구는 조선시대의 형법사상을 연구함에 있어 독창적인 과학수사기법도 고찰하고자 한다. 법과학 수사연구는 조선시대 추관지, 흠흠신서, 증수무원록 등과 같은 형사정책서에 바탕을 두고 있는데, 살인사건이나 강력사건 등 에 대해 조선시대 사람들은 어떠한 과학적인 수사절차를 통해 사건을 접근하고 해결 했는지 검토해보고 이를 통해 조선시대 형정관들의 사건처리 과정의 인본성을 살펴보았다. 이러한 형사정책사상은 다산 정약용의 흠휼사상의 내용과도 일맥상통한다. 본 논문은 조선 후기 법치주의 사상과 형법사상의 이론과 철학을 연구함으로써 형정사상의 역사적 규범을 조명하고 응용하는 단초가 된다고 본다.
Abstract
The goal of this study is to illuminate the confucious thoughts of chosun dynasty and criminal policy. This study explores Chosun Dynasty’s scientific investigation and penal administration systems in key central organizations, such as Criminal Theory of Confucian Thoughts, Ethics and penal civil servants. That time, chosun dynasty civil servants sometimes was partial towards the opposition people and general people. Even with substantial proofs and criminal procedure the civil servants did not fully investigate if he should become vulnerable of criminal knowledge. Another major explanation of increasing incidence of crime is the complexity of criminal pattern and investigations associated with chinese influence and confucious factors. Studies by chung yak yong suggest that two principal factors of criminal system and humanism. These two facts need further explication in order to examine our modern penal policy building. I analyzed that many of environments contain all the elements of bureaucrats crime and authority, deviance and anomie, crime and corruption and vulgarity and violence caused by elite class in chosun dynasty. The analyses and legislative measures designed by these chosun penal policy and chosun countries were based on solid classic research, which I uncovered in my translations and interviews with confucious men in those countries. First, introduce the facts and theory of chosun dynasty and chinese country, which are noted for the criminal Policy in cofucious thoughts. Second, to define each of the functions and problems of chosun dynasty criminal systems, including mokminshim seo, heum heum shim seo, guyeong kook dae jeon in chosun dynasty, dae myeong ryeul in chinese. Third, to examine the criminal case studys and their problems in chosun dynasty and the possible answers with focus on chung yak yong, penal confucious thoughts and his humanism to the people. Fourth, this paper shows that although criminal policy of chosun dynasty was incompletion, non investigation, civil servants have and must be humanism, broadminded spirit for people.
