공정거래 자율준수 프로그램의 제도분석과 문제점 및 개선방안에 관한 연구

In these day’s competition enforcement environment, not only South Korea but also worldwide area, firms and its executives exposure to massive fines for the firms and criminal sentences for the individuals. Compliance Program is internal regulations in order to prevent unlawful acts and comply relating competition laws. If a firm operates well-designed Compliance Program, the firm could prevent penalty surcharge or compensation damages and receive various administrative incentives. In the world wide, especially leading developed countries try to introduce and enlarge their Compliance Program, because of many benefits of the program. This article discusses not only general and comparative subject of Compliance Program, but also current problematic issues. If an effective Compliance Program spread throughout corporate culture, the culture provides a positive effect to overall economic units including firms, consumers and competition bureaus. So an incentive system of Compliance Program is very important to firms’ decision for adopting or operating the program. However, recent days, the incentive of Compliance Program is reduced by revised public announcement, so this article also focused on the issue. Moreover this article proposes some plans considering Compliance Program’s enhancement.
