이미 우리 일상에 깊숙이 자리 잡은 CCTV는 범죄예방을 주된 목적으로 활용되고 있다. CCTV는 여러 가지 범죄예방조치 중에서 규범위반을 저지하기 위해 사실상의 예방조치들을 시도하는 기술적 범죄예방의 대표적인 기술에 속한다. 그러나 실제로 CCTV가 범죄예방의 효과를 보이는지는 여전히 논란 중에 있다. 본 논문에서는 우선, 기술적 범죄예방조치로서 범죄예방효과가 있는 것으로 알려진 CCTV의 효과와 관련한 찬반논의를 간략하게 고찰한다. 다음으로, CCTV를 통한 범죄예방효과 연구의 결과와 그 전제조건, 그리고 현재의 CCTV 범죄예방정책의 한계를 논의한다. 다음으로, 이를 기초로 CCTV라는 기술적 조치가 지닌 규범적 함의를 살피고, CCTV를 통한 범죄예방정책에서 형법의 비례성 원칙이 어떤 의미를 지니는지를 논의한다. 다음으로, 형법의 비례성 관점에서 CCTV 관련 형사규제 법제가 비교적 잘 정비되어 있는 독일, 영국의 법제와 우리의 법제를 비교·검토하여 우리 법제의 개정방향을 제안하기로 한다. 특히, 이러한 비교분석작업은 범죄예방 목적의 CCTV를 규율하고 있는 우리의 개인정보보호법 제25조의 개선방향에 중점을 둔다. 마지막으로, 범죄예방 목적의 CCTV 규제를 위한 미래의 형사 정책적 방향을 간략하게 언급하면서 본 논문을 마무리한다.
Abstract
CCTV, which has already been proliferated in our everyday life, is used, primarily, for the purpose of crime prevention. CCTV, amongst many of the measures for crime prevention, is a representative of the technological crime prevention applied in an attempt to deter violations of norm. However, the discussions and debates over the effect of CCTV on crime prevention are still ongoing. In this paper, the controversy over the effect of CCTV on crime prevention will be briefly covered, first. Then, I will discuss the existing literature on the effect of CCTV on crime prevention in terms of the results and preconditions and the limitations of the current CCTV policies for crime prevention. Next, the normative implications of CCTV as a technological measure and the meaning of the principle of proportionality in the context of the crime prevention policy using CCTV will be discussed. On the next stage, the Korean legal system will be reviewed in comparison with the British and the German legal systems in which the regulations on CCTV are relatively well arranged from the perspective of the principle of proportionality, to suggest a direction for amending the Korean law. The comparative analysis used in this study is conducive to providing the direction for improving the Article 25 of the Personal Data Protection Act of Korea which regulates CCTV systems installed for the purpose of crime prevention. Lastly, the direction of criminal justice policy for the regulations on CCTV for crime prevention will be mentioned.
