이슬람 금융의 무이자 제도에 관한 연구

초록
글로벌 금융위기에 그 안정성이 검증된 이슬람 금융은 오일머니를 위시한 풍부한 이슬람 자본력으로 새로운 국제금융의 대안으로 제시되고 있다. 이에 세계 각국은 이슬람 금융을 유치하기 위해 적극적으로 자국의 법령을 개정하거나 이슬람 금융기법을 활용하고 있다. 그러나 우리의 경우 수쿠크의 도입을 위한 관련법령 개정에 실패하였는바, 이는 이슬람 금융에 대한 전반적인 이해의 부족과 이슬람에 대한 편견에서 비롯된 것이라 할 수 있다. 이러한 오해의 원인이 되는 이슬람 금융의 제도적 특성은 비단 이슬람 채권인 수쿠크에 한정되어 있지 않고 무이자 원칙으로 운영되는 각종 이슬람 금융제도 전반에 걸쳐 있다. 따라서 무이자 원칙으로 운영되는 다양한 이슬람 금융기법을 연구하는 것이 이슬람 금융에 대한 이해도를 증진시킬 뿐만 아니라 우리의 금융제도에도 반영할 수 있는 다른 시각에서의 금융제도를 연구한다는 점에서 그 의의가 크다고 하겠다. 이슬람의 무이자 금융기법 중에서 무다라바와 같은 제도는 단순히 일반적인 투자제도에 그치는 것이 아니라 투자자에게 위험과 손실을 모두 귀속시킴으로써 신중한 투자를 유도하고 투자자로 하여금 투자처에 대한 적극적 감독에 나서게 해 민주적 경영방식의 정착에 일조할 수 있다. 또 무라바하의 경우 금융기관이 단순히 개인이 행하는 매매활동을 매개해 줌으로써 서류상으로 거래활동에 개입하는 것에 그치는 것이 아니라 목적물에 대한 소유권의 완전한 확보와 하자에 대한 위험부담을 통해 실질적으로 그 거래관계에 일익을 담당하게 된다. 이를 통해 특정 목적물을 매수하고자 하는 개인은 더욱 안전하게 그 목적물의 소유권을 확보할 수 있게 된다는 점에서 소비자 보호에 일조할 수 있다. 무샤라카의 경우에는 복수의 주체가 서로 합의하여 사업을 경영할 것을 목적으로 하는데, 우리 법상 조합에 가까운 형태로 그 구성원들이 상부상조 정신에 입각한 공동의 이익을 추구한다는 점에서 경제적 약자인 영세 사업자들을 보호할 뿐만 아니라 대기업 위주의 경제 생태계를 다원화할 수 있는 역할을 수행할 수도 있을 것이다. 뿐만 아니라 우리의 임대차나 리스제도와 유사한 이자라는 임대인에게 보다 많은 의무를 부과하고 있고 무분별한 임대료 산정을 배제한다는 측면에서 임차인 보호에 기여하는 바가 크다고 할 수 있다. 우리의 경우에는 아직 국가적 차원에서 이슬람 금융을 도입하고 있지 못하고, 개별 기업단위에서 이슬람 시장진출을 위한 자체적인 노력만 하고 있을 뿐이다. 그러나 세계적인 금융위기를 통해 오일자본의 활용성과 이슬람 금융의 안정성이 확인되었기 때문에, 우리 정부는 이미 이슬람 금융에 호의적 태도를 가진 주변국가보다 더욱 적극적으로 이슬람 금융도입에 힘써야 할 것이다.
Abstract
The essence of Islamic finance is the trade in physical, productive assets and the sharing of risks in the development of projects based on interest-free economy. So, under Islamic finance, the financier cannot receive a monetary benefit if there is no sharing of risk on his/her part. Financial institution, including Islamic bank, offering Islamic finance must comply with sharia doctrines, which include (i) avoiding interest, or unlawful gain, called 'riba', (ii) avoiding excessive risk taking called 'gharar', and (iii) recognizing that money has no time value. The current forms of Islamic finance are as the followings; (i) A mudaraba is an agreement between an investor and an agent. Investors provide capital for the project and the agent invests the funds according to the investors' instructions. Profits from the investment are shared between the two at a predetermined ratio. Any accrued losses are borne by the investor. (ii) A murabaha is that the bank first buys the asset, then sells it to the client at a price which includes the bank's profit. The selling price is fixed at the time the facility is funded. (iii) A musharaka is an Islamic mode of finance in which capital is provided by two or more parties for project development. The profits are shared among the parties on the basis of their participation or on a pre-agreed ration and the losses are shared on the basis of equity participation. (iv) An ijara is that the bank agrees to purchase the equipment and lease it to the client for a rental fee. The bank as lessor has ownership of the assets. With the growing demand for Islamic finance, many non-Islamic countries, including Japan, are beginning to amend or adopt their domestic related norms and system for better using Islamic finance. Considering that the continuing growth of Islamic finance will be an alternative system to conventional finance, our government should actively participate with Islamic finance market.
