야간로스쿨 설치 방안: 법률전문직의 진입장벽 완화를 위한 제안

시험에 의한 선발에서 교육에 의한 양성이라는 모토하에 도입된 로스쿨제도는 그 본래의 취지와는 달리 총입학정원제와 이에 의거한 허가제방식의 설립인가제 등으로 인하여 사회의 계층간격을 강화하는 기제로 작용하고 있는 것이 현실이다. 그리고 이는 사법시험제도를 존치하여야 한다는 사회 일각의 주장을 뒷받침하는 근거로 이용되기도 한다. 이에 이 글에서는 로스쿨제도가 가지는 계층화효과의 원인이 무엇인지 규명하고 그것을 극복하기 위한 대안을 모색해 보았다. 실제 장학제도나 사회적 약자에 대한 특레입학 등 나름의 안전장치를 구비하고 있는 로스쿨제도의 경우 그 등록금의 다과가 사회·경제적 약자들이 로스쿨에 접근하는 것을 가로막는 결정적인 진입장벽이라 하기 어렵다. 특히 이를 사법시험제도의 경우와 대비할 때 더욱 그러하다. 오히려 전일제 수업체제를 갖추고 있다는 점이 제2의 직업으로서의 법률전문직을 추구하고자 하는 사람들의 진입을 가로막는 최대의 원인이 된다. 직장인이나 가사종사인 등과 같이 낮 시간 동안 풀 타임으로 근무하여야 하는 사람들이 로스쿨에 입학하기 위해서는 자신의 현재의 경력 자체를 포기하여야 하기 때문이다. 이에 이 글에서는 야간로스쿨을 설치함으로써 이러한 사람들이 법률전문가로 될 수 있는 기회를 확장할 것을 주장한다. 이를 위해 먼저 로스쿨제도의 본산이라 할 미국에서의 야간로스쿨제도의 경과와 현황, 그리고 그 장단점을 살펴본 다음, 우리 사회에 이러한 야간로스쿨제도를 도입할 때 고려해야 할 사항들을 검토해 보았다.
Abstract
The law school system, which has been adopted since 2009, are curently confronting sarcastic critics from previleged group of lawyers that it is not open to the have-nots who are struggling to rise from humble families and/or classes, because it is designed as so much expensive graduate school. But, Ch.2 of this essay tries to prove that such contention says just a little part of truth. The scholarship plans in every law schoools in Korea can provide most students from lower income classes with sufficient amount of money for their tuitions. What is the real problem with the system is that it can admit only full time students: anyone who has to keep his/her full time job in day time or to manage his/her familial caring for all the day time can not attend to these full time law schools, which means that he/she is excluded from the way to become a lawyer. This essay tries to make some design of evening law schools in Korea, which can make him/her another chances to be a laywer and change his/her job careers. U.S. has well developed part-time law school since mid-1860s, which is briefly introduced in Ch. 3 with summary of the merits and demerits of the school. Ch.4 makes some structural design of evening law school system focusing on such issues as: number of schools and students, their curricula, pedagogical proposals, facilities and equipments, and so on.
