제1기 헌법재판소 최광률 재판관의 판결성향 분석

한 나라의 최고법원인 헌법재판소 결정에 가장 직접적인 영향을 미치는 것은 개별 헌법재판관들의 판결성향이라고 할 수 있다. 우리나라에서 1988년부터 1994년까지 6년간 활동한 제1기 헌법재판소의 판결성향도 9명 헌법재판관들 각자의 판결성향이 만들어낸 결과물이라 할 수 있다. 이 9명의 제1기 헌법재판관 중에는 7년간의 판사생활 이후 오래 동안 변호사생활을 하며 법원 밖에서도 상당한 법조경력을 쌓은 최광률 헌법재판관이 있다. 본 연구는 이러한 최광률 헌법재판관의 판결성향을 분야별 주요사건을 중심으로 정성적으로도 평가해보고, 전체 사건의 통계를 통해 정량적으로도 분석해 봄으로써 최광률 재판관의 판결성향을 귀납해 보는 것을 연구목적으로 삼는다. 이를 위해 본 연구는 우선 최광률 헌법재판관의 주요 경력과 행적을 제1기 헌법재판관으로 임명되기 이전과 이후로 나누어 상세히 살펴본다. 또한 최광률 재판관이 제1기 헌법재판관으로 재직하는 동안 관여했던 주요 사건들 중, 그의 판결성향이 비교적 잘 드러나는 대표적 결정들을 정치, 경제, 사회·문화의 분야별로 선별하여 정성적으로 분석하고 평가해본다. 또한 최광률 헌법재판관이 제1기 헌법재판관으로 재직한 6년 동안 관여했던 모든 전원재판부 사건들을 대상으로 정량분석도 시도해본다.
Abstract
This paper aims at analyzing the judicial inclination of the Justice Kwang-Ryul Choi in the First Korean Constitutional Court who had been a judge until his 30s and appointed as a Justice in the First Korean Constitutional in the year of 1988. To achieve the aim, this paper will examine the life path and the judicial career of the Justice Choi before and after his appointment in the Court. Then, it will qualitatively analyze his opinions as a Justice in the Korean Constitutional Court through the four major cases representing political, economic, social and cultural fields. This paper will also quantitatively analyze his whole opinions in 372 cases based on the statistics. For these analyses, the analytical frames such as ‘judicial activism v. judicial passivism’ and ‘judicial progressivism v. judicial conservatism’ will be applied.
