컴플릿가챠에 대한 일본 경품표시법상의 규제

The regulation for Complete Gacha in Japan

트위터, 페이스북과 같은 SNS(Social Network Service)의 발달과 함께 이를 기반으로 한 SNG(SocialNetwork Game) 시장이 급성장하고 있다. 일본에서도 소셜게임은 피처폰(feature phone) 시대부터활성화되어 스마트폰(smart phone) 시대를 맞이하여 더욱 폭발적으로 증가하였다. 그러나 소셜게임을 중심으로 수많은 게임타이틀에 도입되었던 課金方法의 하나인 ‘컴플릿가챠(컴프가챠)’에 대하여 비용이 많이 든다는 비난이 제기되었고, 우리나라에도 모바일 카드게임에 컴플릿가챠가 등장하였다. 컴플릿가챠는 가챠로 게임에서 지정된 아이템이나 카드를 모아 조합함으로써 더욱 희소성이높은 아이템이나 카드를 손에 넣을 수 있는 구조로, 게임 업체에서 1인당 과금 단가를 올리는방법으로 이용되기 시작했다. 전형적인 컴플릿가챠는 有料가챠등의 랜덤아이템課金에 의해 제공되는 둘이상의 다른 종류의 아이템 등을 포함한 특정한 조합을 사전에 명시하고, 당해 조합을갖춘 이용자에 대하여 다른 아이템 등을 제공하는 방법이다. 이를 좀 더 발전시킨 것은 전형적인컴플릿가챠에 추가하여 당해 조합을 갖춘 이용자에 대하여 게임내이벤트에 참가하는 기회를 부여하고, 당해 이벤트를 완성하는 등 일정조건을 충족한 경우에 다른 아이템 등을 제공하는 방법이다. 일본에서 문제가 된 컴플릿가챠는 특정카드들을 수집하면 레어 아이템을 제공하는데, 오직 정해진 기간에만 뽑을 수 있고, 랜덤으로 아이템이 지급되기 때문에 같은 카드가 또 나올 수도있으며, 이벤트와는 상관없는 카드도 나오는 만큼, 실제로 모든 카드를 수집하기가 매우 어렵다. 또한 레어 아이템을 뽑기 위하여 구매 횟수가 많아져 이에 고액의 비용청구를 받게 되는 사례가증가하였다. 일본 소비자청은 2012년 5월 18일 온라인게임에서 행해진 컴플릿가챠에 대하여 ‘카드맞추기’에 해당한다고 하였다. 일본 소비자청은 단순한 유료가챠에 대하여는 거래부수성이 없다고 판단하였고, 이에 경제상의 이익을 제공받더라도 경품규제의 대상이 아니라고 판단하였다. 이에 반하여 컴플릿가챠에 대한 경품규제의 성립요건으로서 거래부수성기준과 경제상의 이익기준에 대하여 컴플릿가챠에 대해서는 거래부수성이 있고 경제상의 이익이 있다고 판단하였고, 컴플릿가챠에서 제공되는 아이템 등은 경품류에 해당한다고 판단하였다. 또한 컴플릿가챠에 의한 아이템등 제공행위는 현상경품제한고시 제5항에서 금지하는 ‘카드맞추기’에 해당한다고 판단하였다. 현재 국내 게임업계에서는 컴플릿가챠에 대한 문제 제기나 자율규제의 움직임이 일지 않고 있다. 우리나라의 경우 경품규제의 대상에서 카드맞추기가 포함되어있지 않으며, 게임규제차원에서 각 게임별 과금에 대하여 상한이 제한되어있어 그 위험성이 약화되었기 때문이라고 생각된다. 또한 게임관련위원회에서는 이러한 레어카드와 같은 것에 대해 경제상의 이익이 아니라 하여 경품으로 보고있지 않다. 이에 대한 대비책으로서 공정거래위원회는 경품고시를 정비하여 이를 규제할 수 있도록 하여야 할 것이다.

Abstract

“Complete Gacha”, a virtual card-collection system based on a paid lucky-dip-style gaming calledgacha, also referred to as “Compugacha” or “Kompu Gacha” in Japan, means the method by whichusers are provided with certain premium virtual items, usable in Social Games, but only on thecondition that they obtain two or more different Items, including at least one Gacha Charge Item. “Gacha Charge Items” means Gacha Items that may be obtained by users in exchange for a GachaCharge payment. Where Gacha Items can be obtained either through Gacha Charge or other methods,such Gacha Item shall be deemed to be a Gacha Charge Item. Typical Complete Gacha is a case where users are clearly shown a pre-determined combination oftwo or more different virtual Items that can be obtained through Random Item Charge such as PaidGacha as a condition to getting another virtual Item. Complete Gacha is a potentially huge income generator for mobile-social titles. It’s a kind ofvirtual vending machine — a digital version of one of those old-fashioned toy machines you see ingrocery stores, where you pop in a quarter and it randomly spits out a plastic bubble with a toyinside. In “complete gacha” players try to collect a whole set of prizes from these machines; onlywhen they get the whole set can they unlock a rare item. It’s easy to see the value to developersand publishers: Players could pour money into the game indefinitely and still come no closer togetting the prize they want. Japan’s Consumer Affairs Agency secretary stated at a regular briefing that Complete Gacha couldbe thought of as “prizes” under the prize regulations (Law for Preventing Unjustifiable Extras orUnexpected Benefit and Misleading Representation). Japan’s Consumer Affairs Agency has declared theonce-ubiquitous mobile-social game mechanic of Complete Gacha to be illegal, Complete Gacha will beconsidered as “card matching”, which is banned by the Japanese Act Against Unjustifiable Premiumsand Misleading Representations.
