개인정보 수집 및 활용 동의서에 대한 이용자 인식 분석 및 대응 정책에 대한 연구

개인정보의 보호를 위하여 개인의 정보를 수집하고 이용할 때는 반드시 이용자의 동의를 획득하도록 개인정보보호법에서 규정하고 있다. 이에 따라 인터넷 서비스 사업자는 서비스 이용자에 대하여 개인정보에 대한 수집 및 이용에 대한 동의서를 요구하고, 동의서에 나타나 있는 범위 내에서만 개인정보를 활용함을 이용자에게 알리고 있다. 그러나 이용자는 동의서의 내용을 정확히 파악하지 못하고 있으며, 이용자가 알지 못하는 동안 이용자의 개인정보가 이용자의 동의하에 다른 곳에서 이용되는 개인정보의 2차 이용이 일상화 되고 있다. 이와 같은 법과 현실 사이의 차이의 원인을 밝히기 위하여 본 논문에서는 설문 조사를 통하여 개인정보 수집 및 활용 동의서에 대한 이용자의 인식을 조사하였다. 그 결과, 개인정보보호를 위하여 법적으로 규정된 개인정보 활용 동의서를 이용자가 읽지 않는다는 문제점을 명확히 하고, 그 원인을 분석하였다. 또한, 이를 통하여 개인정보 이용에 있어서 보장되어야 할 이용자의 권리가 침해되고 있음을 밝히고, 이에 대한 대응 방안을 제시하였다.
Abstract
Personal information protection law regulates user's agreement to collect and use user's personal information for privacy protection. Service providers must get user’s agreement to collect and use user’s personal information. Also, they must inform users how to be used personal information. However, users have not the least idea of the personal information agreement, it results in 2nd use of personal information under user’s agreement. To find a cause of a gap between law and reality, we analyzed user’s recognition for personal information agreement through questionnaire survey. We illuminated the problem that most of users click “I agree” without reading the personal information agreement, and analyzed the cause of this problem. We determined that user's right on personal information law is infringed through these problems. We proposed new policy based on our questionnaire survey results.
