창조경제와 특허괴물: 지식재산금융 활성화 방안
Creative Economy and Patent Troll: A Study On the Activation of Intellectual Property Finance

초록
본 연구는 특허괴물과 지식재산금융의 개념을 이해하고 특허권과 지식재산금융의 현황을 살펴보며, 지식재산금융 운용 사례를 짚어본다. 그리고 지식재산금융 활성화 방안을 논의한다. 지식재산금융은 지식재산의 창출·보호·활용을 통하여 선순환적 창조경제 생태계를 구축한다. 지식재산금융은 아이디어, 특허 등에 투자하여 이의 권리화 및 관리, 라이선싱 등을 통해 부가가치를 창출하며, 특허사냥꾼으로 일컬어지는 특허괴물(patent troll) 등 특허관리전문회사(non practicing equity: NPE)에 대항하는 기능도 수행한다. 인벤션캐피탈(invention capital)은 벤처캐피탈(venture capital)을 재창조하여 만든 것으로 벤처캐피탈은 회사에 투자하지만, 인벤션캐피탈은 아이디어라는 무형의 자산인 발명에 투자한다. 인벤션캐피탈의 활성화를 위해 국내외의 여건을 분석하고 운영 모델을 개발하는 것이 필요하다. 그리고 우리나라 지식재산금융인 인텔렉추얼 디스커버리사의 역할을 강화할 수 있는 방안의 모색이 필요하다. 성공적인 국외 인벤션캐피탈의 구조 분석, 인벤션캐피탈의 성립과정, 현황 및 경영 전략 등을 포함한 인벤션캐피탈 도입에 대해 검토할 필요성이 있다.
Abstract
This study is understanding the concept of the patent troll and intellectual property, watching the status of patents and intellectual property finance, practicing intellectual property financial management, and intellectual property finance discussed ways to activate. Intellectual property finance creates a line of domestic cyclical of creative economic ecosystems through the creation, protection and leverage of intellectual property. Intellectual property finance is invested in the ideas and patents, and is created added value through these rights and management licensing. It is also performed the function against the patent troll, patent shark, and non practicing equity. Invention capital is made by recreating the venture capital. Venture capital is invested in thecompany, but invention capital invested in intangible assets of invention, is called the idea. This study was created in order to activate the capital invention of the analysis of theconditions at home and abroad, and it is necessary for the development of operational models. Also,Korea intellectual property finance, Intellectual Discovery co., Ltd., should find ways to strengthentheir role. Included is the analysis of the structure of the successful international invention capital, theprocess of the conclusion of the invention capital, status and management strategies, and a need toreview about the introduction of the invention capital.
