지방재정 위기와 지방자치단체 파산제도 도입에 관한 연구－지방자치권 훼손여부와 지방재정 건전화 방안을 중심으로－

인천시와 성남시 등 수많은 지방자치단체들은 현재 심각한 재정위기 상황에 직면해 있다. 이러한 재정난은 해당 자치단체의 단체장과 지방의회의 과도한 공약사업 및 방만한 경영 때문에 발생한 측면이 있지만 지방재정의 구조적 문제와 국세 및 지방세의 비매칭 등이 근본적 원인으로 지목되고 있다. 즉, 지방자치제도가 도입된 시점부터 지방 재정이 악화될 수밖에 없는 다양한 원인들이 존재하고 있는 것이다. 한편, 이와 관련하여 안전행정부는 2014년 업무보고를 통하여 상반기 중 재정기능이 마비된 지방자치단체 파산제도 도입방안을 만들고 하반기에는 법제화를 추진하겠다고 발표하였다. 하지만 지방차지단체 파산제도가 지방재정 건전화를 위한 목적으로 시행된다고 하여도 현실적인 지방재정위기 원인이 해소되지 않는 이상 무리한 도입은 오히려 역효과를 가지고 올 수 있다. 일반적으로 지방자치단체 파산제도는 파산관재인을 선임하는 방안과 중앙의 재정지원 및 관리감독을 통한 제도 시행 방안 등이 있지만 최종적으로 지방 재정권을 포함한 지방 자치권과 주민의 권한이 침해되지 않는 범위 내에서 도입되어야 한다. 따라서 의회의 기능을 축소하고 단체장을 해임하여 파산관재인 주도로 파산절차를 진행하는 방안은 지방자치단체의 자치권이 심각하게 훼손되고 주민의 기본권이 침해되기 때문에 실제 도입은 어렵다고 판단된다. 하지만 지방의회의 기능을 보장한 상태에서 중앙의 재정지원과 관리ㆍ감독이 이루어진다면 지방자치단체의 자치권을 훼손할 위험이 적고 동시에 지방재정 건전화 목적도 달성할 수 있기 때문에 타당하다. 현재 우리나라는 사전ㆍ사후적 위기관리 시스템이 구축되어 있고 이를 충분히 활용하면 지방의 재정 악화에 대비할 수 있을 것으로 보인다. 여기에 추가적으로 지방자치단체 파산제도를 도입하여 재정위기에 대한 요건과 효과를 명확히 규정하고 통합적 위기관리 시스템을 구축한다면 위기 상황에 효율적으로 대응할 수 있을 것이다. 또한 지방재정의 위기 문제는 파산제도의 도입으로 단숨에 해결할 수 있는 성질의 것이 아니기 때문에 지방재정의 자율권 부여, 지방세 분야 개선, 국고보조금 지급 조정, 지방자치단체에 대한 감독 및 인센티브 지급 등 지방재정을 건전화할 수 있는 방안들과 함께 시행되어야 한다.
Abstract
This study deals with the local finance crisis and the local self-government bankruptcy, especially focused on the damage of the local self-government's right and the way how we can improve the financial health. Now many local self-governments are faced with finance crisis in KOREA. This crisis is happened by the careless management of the local government head and local councilors, in fact, however the important causes are a structural problem of the local finance and a miss matching between a national tax and a local tax. And then we have to approach the solutions of the local finance crisis through a variety of viewpoints. On the other hand, the Ministry of Security and Public Administration is going to legislate the bankruptcy system of the local government within the year. But if the causes of the finance crisis still remain, the adoption of the bankruptcy system of the local government has the opposite effect. So the bankruptcy system of the local government is adopted carefully. If a trustee in bankruptcy watch and control the operation of local government finance efficiently as soon as a local assembly is dissolved and the local government head is dismissed, this system violate the right of the local self-government and residents excessively. Therefore, the central government supports the finance to the local self-government without the disperse, and supervises the local self-government to the extent of not hurting right of assembly and residents. We have the preliminary and post system which is managing the finance risk. If the government utilize the bankruptcy system of the local government additionally, we prepare for the local finance crisis fully. And then the local finance health methods like the right of the local finance self-control are enforced at the same time
