현행 조세구제제도의 문제점과 개선방안에 관한 연구

초록
본 연구는 조세불복에 관한 문제를 분석하고 제도의 개선 방안을 모색하고자 하였으며 그 개선 방안을 제시하고자 한다. 첫째, 사전구제제도인 과세전적부심사제도의 실효성을 위해 과세전적부심사제도를 1심급에서 2심급으로 그 단계를 조정하고, 납세자보호담당관제도를 국세기본법에 명문화하고 별도의 조직으로 구성하는 것 또한 필요하다. 둘째, 사전구제제도인 과세전적부심사제도인 강화로 현재 재결기관과의 절차가 중복되어 있는 이의신청과 심사청구제도를 폐지하고 국세심판 청구 제도로 일원화하여 행정편의주의적인 운영에서 벗어난 신속한 납세자의 권리구제가 필요하다. 셋째, 조세심판원의 지방지원 설치로 국세심판관의 과중한 업무 및 지방 납세자의 불편을 해소하도록 하여야 한다. 넷째, 납세자의 권리구제를 위한 마지막 제도인 조세소송은 고도의 전문성과 기술이 필요하며 재판기관 또한 마찬가지이다. 조세문제는 대량 반복적으로 발생하며 이를 전문적으로 해결하기 위해 조세법원의 설치는 납세자의 권리보호를 위해 반드시 설치되어야 한다. 다섯째, 납세자권리현장에서 규정한 납세자의 조력을 받을 권리를 위해 조세소송대리에 있어서 변호사 강제주의를 폐지하고 조세전문가인 세무사에게도 그 대리권을 인정하여 납세자의 선택에 의해 양질의 법률 서비스를 제공 받을 수 있도록 해야 한다.
Abstract
This study suggested the following developmental plan about the current tax remedy system. First, a reviewing legality before taxation system should be arranged not by tax administration but by the third independent institution and then be operated as double trial system, and tax-payer protection officers system needs to be stipulated on general law of the national taxes. Second, the request of any objection and the demand of inspection is abolished and then is unificated to the demand of judging, the structure of judging step should be simplified. Third, Inconvenience of tax-payer should be solved as the establishment of local branch offices of Tax Tribunal. Fourth, for the problem of taxes which occurs repeatedly in a large quantity, the establishment of court specializing in taxes is required. Fifth, the forced-lawyer-employ-system should be abrogated for the legal agents concerning tax legal proceedings, and the right of representation lawsuit should be given to certified tax accountants who are specialists for taxes and tax-payer's interests should be taken a deep consideration.
