개정 WTO 정부조달협정과 지방계약법의 발전방안

Revised WTO Government Procurement Agreement(GPA) took effect from April 2014. Although Korea did not yet accept this revised GPA due to controversies on railroad industry privatization, Korean government should prepare for the effect of revised GPA. In particular, Korean local government should take heed on the expansion of coverage of revised GPA which included local governments (Gu) affiliated to major metropolitan cities. In the context of GPA, three improvements on local government contract law can be suggested. First, local governments should be active to expanded government procurement global market. In this perspective, it is recommended that local governments share information on purchasing foreign products or services based on the local government contact law and should not remain reluctantly in conducting international bidding. Second, cooperative purchasing should be actively implemented for the economy of scale and enhanced efficiency. To this ends, cooperative agreement between local governments should be dealt in more enhanced level of legislation or regulation. In using cooperative purchasing, local government should be careful in evaluation of threshold in GPA application. Third, local governments should strategically use various socio-economic policy based on the exclusion of coverage in revised GPA. For example, local government should link 'socially responsible public procurement' (SRPP) with exclusion of set-aside for small and medium sized enterprises (SMEs) products in revised GPA.
