엘리트 스포츠 성폭력 문제에 대한 법적 해석- 쇼트트랙 실업팀 내 성추행 사건을 중심으로 -

본 연구의 목적은 최근 우리나라에서 발생한 쇼트트랙 실업팀 내 성추행 사건을 사례를 바탕으로 하여최근 우리나라에서 자주 발생하는 엘리트 스포츠계의성추행 사건에 대하여 법률적으로 접근하여 그 관계를 분석하고, 이를 방지할 수 있는 제도적 방안을 제안하는 데 있다. 우리나라에서는 스포츠의 발전을 도모하고, 또한 이에 기여하기 위하여 공공기관과 몇몇기업들이 실업팀을 구성하여 위탁형식으로 운영하고있으며 쇼트트랙 팀도 그 가운데 하나라고 할 수 있다. 이러한 우리나라의 스포츠 조직 내에서 엘리트 선수들은 그 경력을 발전시키기 위하여 지도자층과 상당히 인격적으로 가까운 관계를 맺고 있는 것이 사실이다. 하지만 최근 발생한 성추행 사건은 이러한 인격적 관계를 악용하고 개인적인 성적욕구를 불법적으로채우려한 몇몇 지도자에 의하여 발생하였다. 이에 본연구에서는 성폭력 피해자의 권익을 이해하기 위하여보다 객관적으로 이해하려하였으며, 이를 위하여 형사적 책임관계와 동시에 민사적 책임관계로도 접근하고자 하였다. 이에 따른 결과로 첫째, 본 사례의 경우단순히 충동적이라 보기엔 매우 악의적인 범행으로판단된다. 둘째, 미성년자 성추행 및 제도상 존재하는권력관계를 이용한 악의적인 범죄 행위임을 감안할때, 특정 범죄 가증 처벌 등에 관한 법률을 적용한다. 셋째, 성폭력 가해자는 피해자에게 손해배상의 의무를가진다. 또한 추후 연구에 대한 제언으로는 성범죄에대한 데이터베이스의 구축이 요구 되며 스포츠 성범죄와 관련하여 보다 진보적인 제도의 개발이 필요하다. 이와 같은 제도적 제안점을 통하여 한국 엘리트스포츠 분야에서 발생한 성폭력의 근절을 기대하고더 나아가 건강한 인권의 성립과 활용에서 기여할 것으로 기대하는 바이다.
Abstract
The purpose of this study was to micro-analyze asexual harrassment case of Short Track team witha view of Korean Civil Law. In Korea, many publicinstitutions manage semi-professional sport teams tocontribute on sport development in Korea and Shorttrack is one of the sports. Under this sports teammanagement structure, the athletes better be closedpersonally to the leaders like head coach for theirathletic career. However, certain leaders use thisrelationship and structure to fulfill their sexualdesire severly. To make matters critical for thesports in Korea, there is a cruel irony is that fewhas a feeling of civil duty and criminal duty asideagainst the damage. So, we tried to understand thesexual harrassment case objectively and severalsuggestions are included in the end of this researchas the results. This research is expected possibly toestablish the stable environment for elite athletes inKorea and secure the human rights basically.
