고용촉진지원제도 관련 판례분석 연구

초록
본 연구는 노동시장의 통상적 조건 하에서 고용의 취약계층인 장애인과 고령자의 고용촉진을 위한 지원제도와 관련하여 어떤 소송들이 이루어지고 있는 지 그 내용을 검토하고 이를 통해 지원제도의 개선방안을 살펴보는 데 목적이 있다. 이 연구에서는 장애인의무고용, 고령자 고용관련 지원금과 관련된 것 중 판시의 내용상 중복되는 재판을 제외하고 비교적 사실관계가 명확하여 판시사항의 본문검토가 가능한 판례를 선정하여 분석하였다. 그리하여 헌법재판소결정 2건, 대법원판례 3건, 그 밖의 하급심판례 및 행정 법원판례 2건을 분석대상으로 사용하였다. 그 결과 장애인 고용촉진에 있어 대통령령에 백지위임한 규정을 수정하고, 장애인 고용이 현실적으로 이루어질 수 있도록 제반 여건들을 법령에 추가적으로 명시하도록 하고, 재판해석이 좀 더 적극적으로 이루어질 필요성이 있으며 고령자 고용 지원의 기준을 명확히 입법 상에서 밝혀주어야 함을 제시하였다. 본 연구는 고용시장에서 취약계층에 해당하는 이들의 고용촉진을 위한 법적인 문제점을 살펴 이들을 위한 개선방안을 제시하였다는 데 의의가 있다.
Abstract
The objective of this study is to review suits related to the employment promotion for vulnerable social group such as disabled person, aged person etc. under the normal conditions of labor market and improve the improvement methods for the support system. The analyzed precedents in this study are available to check the texts of judgement and clear in fact relation except for some duplicated contents related to promotion of employment of the disabled and employment promotion for the aged. And these analyzed precendents were selected. Therefore, 2 precedents from the Constitutional Court, 3 precedents from supreme court, other precedents from lower courts and 3 precedents from administrative courts were used for analysis. Through this study has a significance in proposing political implications for the vulnerable social group by researching the weak points of acts for the employment promotion.
