차량용 블랙박스에 의한 개인정보침해 - 법적 규제의 필요성과 입법적 대안을 중심으로 -

Recently the growing interest of Automotive Black-Box brought about the rapid increase of its use. Nevertheless, the lack of legal regulations for its installation and use multiplies the risk of the Invasion of Privacy and the criminal exploitation through the leaks of personal information. 43)44) This research describes on the possibility of appling current Personal Information Pretection Act to the automotive black-box in place where there is no legal regulations. And the purpose of this study is to suggest a legislative alternative for the balanced development between personal information protection and industrial revitalization. In conclusion, the images collected by the automotive black-box can be included in the personal information protected by the Personal Information Pretection Act and the literary and teleological interpretation of the Personal Information Pretection Act regards the equipment of automotive black-box as one of the image Data Processing Equipment. And the drivers who intentionally collect images through their black-box can be admitted as a personal information manager and the law should guarantee legal rights of an information subject to the person who recognizes that his images are collected.
