교육자치제도의 제도적 보장에 관한 헌법적 고찰

이미 2006년에 지방교육자치에관한법률 개정을 통하여 전심기관이었던 교육위원회를시⋅도의회 내 상임위원회(교육위원회)로 전환(동법 제4조)한 바 있지만, 교육행정기관을일반행정기관에 통합시키려는 논의도 여전히 매년 반복적으로 지속되어왔다. 종래 양자의 통합문제에 관해서는 교육자치의 기본원리 또는 교육행정의 능률성 등 다양한 논거로 논쟁되어 왔으나, 본 연구에서는 교육행정기관의 통합 등 개편 문제를 교육자치제도의 ‘제도적 보장’이라는 헌법문제로서 접근하고자 하였다. 그간 교육행정기관의 통합에관한 찬반논의 가운데, 교육자치제도의 제도보장성을 인정하고 있는 경우에서조차, 제도보장론적 관점에서 이 문제를 해결하고자 하는 논리는 아직 찾아볼 수 없고, 교육자치제도관련사건을 심판하였던 헌법재판소의 경우에도 지방교육자치제도의 제도보장성을 인정하면서도 사건해결에 관해서는 이를 정면으로 다루지 않았다. 그럼에도 불구하고 본연구에서는 제도적 보장, 특히 그 ‘핵심영역’에 관한 독일에서의 학설과 독일연방헌법재판소의 판결, 그리고 이에 관련된 우리나라에서의 학설⋅결정례를 참고하여, 교육자치제도의 ‘제도적 보장’ 문제에 관해서 시론적(試論的)으로 고찰하고자 하였다.
Abstract
The educational autonomy means the system to guarantee independence, specialtyand political impartialty of education and to execute the specialty of local educationon the level with local government. therefore, the educational autonomy system adoptsindependence, specialty, political impartialty of education and decentralization of poweretc. as fundamental value. the educational autonomy system have to persue the efficiencyand the legitimacy of administration. However, these values occasionally can be placed at a conflict relation one another. on which value should take precedence over the others, In this case, various opinionsare presented in accordance with advocators. Just in time, Issues in relation to valuesof educational autonomy are brought up. These issues related fundamental value ofeducational autonomy are ‘the integrate local educational autonomy system and localautonomy system’ and so on. This study, for the existence of the educational autonomy system, aims to analysethe core of the educational autonomy system that mustn’t be violated, on the groundof theory of the system guarantee of the educational autonomy system.
