강제추행 사건의 집행유예 선고에 있어 동종전과와 진지한 반성의 영향력: 상해가 발생한 13세이상 피해자대상 사건을 중심으로

본 연구는 13세이상 피해자대상으로 상해가 발생한 강제추행사건의 집행유예기준에 대한 경험적 연구들의 부재를 인식하고, 현행 성범죄 집행유예 기준에서 정상참작 요인으로고려된 집행유예 인자들의 상대적 영향력을 추론 통계를 통해 비교·분석하는 것을 주요 목적으로 하였다. 이를 위하여 대검찰청 검찰사건처리정보시스템(PGS)에 입력되어있는 성범죄군 사건 중 13세이상 피해자를 대상으로 행해진, 상해가 발생한 강제추행사건을 분류하고 2009년 7월 1일부터 2012년 5월 14일까지 1심판결이 선고된 사건 총 189건의 사건을 수집하였다. 분석 방식으로는 종속변수가 이항변수임을 고려하여 로지스틱 회귀분석을 사용하였다. 로지스틱 회귀분석의 결점을 보완하고 인자들의 절대적 효과크기를 파악하기 위하여 BIC 지수를 통한 비교분석도 실시하였다. 로지스틱 회귀분석 결과, 총 34개의 집행유예사유에서 4개의 유의미한 인자가 발견되었다. 그러나 36개월 이하의 선고형 사건으로 한정하여 분석해 본 결과, 36개월 이하의 사건에서는 동종전과와 진지한 반성 없음에 해당하는 2개의 인자만이 집행유예 선고에 유의미한 것으로 나타났다. 즉, 전체사건 분석에서의 유의미한 인자들은 다시 말하면 형량 편차를 유발하는 역할을 수행하였고, 총 34개의 인자 중2개의 인자만이 집행유예 결정에 유의미한 차이를 발생하는 요인으로 작용하였다고 말할수 있다. 이를 통해, 13세이상 피해자대상 상해가 발생한 강제추행의 경우 집행유예 기준의비효율성의 문제는 물론, 형사사법 절차에서 지극히 주관적인 판단요인에 해당하는 진지한반성이 유의미성을 보여, 객관성을 추구하는 양형기준 내 집행유예 기준의 투명도와 타당도에 문제를 제기한다. 또한 이러한 경험적 연구를 통한 발견뿐만 아니라 개인책임 비례원칙에 어긋나는 인자들이 존재함을 지적하였다. 전반적인 경험적 연구 분석 결과와 관련된함의들은 본문에서 구체적으로 논의하도록 한다.
Abstract
The purpose of this paper is to describe and examine the significant factors on in-outdecision(suspended sentence) for sexual molesting with injury against over thirteen agedvictims. The data were obtained from the Prosecutorial guideline System (PGS) of the SupremeProsecution Service in Korea. Based on the PGS data archive, a total of 189 availablecases of sexual offense which were sentenced from July 1st, 2009 to May 14th, 2012 werecollected. Due to a characteristic of binary variable for dependent variables(in-outdecision), logistic regressions and the BIC examinations were mainly employed. Theresults contained the frequency for in-out decision factors and the likelihood to besentenced a suspension of sentence for sexual molesting with injury against over 13 agedvictims. The finding showed a criminal history with same crime and no sincere remorseaffected to decrease the likelihood of suspended sentence for the sexual molesting crimewith injury. Moreover, this paper indicated that the entire model of suspended sentence for sexual offense had an issue of the efficacy of predictability. The detailed policyimplications from the empirical research will be discussed in the context.
