허영헌법학의 계보와 발전적 계승

허영 헌법학의 등장은 국내 헌법학계의 새로운 바람이었고, 그 바람은 一瞬이 아닌 명맥있는 흐름이 되어 현재에도 헌법학 내에서 존속․발전되고 있다. 이 글은 ‘공법학 원로와의 대화’ 중 헌법학교수로서의 허영 교수의 일생을 조감하는 자리에서 그 하나의 내용으로 “새로웠던 그 학문적 바람”이었던 허영 헌법학의 계보가 어떻게 존재하는지 그리고 그 이론은 어떻게 발전적으로 계승되고 있는지에 대해서 생각해 본 것이다. 때문에 이 글에서의 계보분류의 기준과 계승내용에 대한 판단은 저자의 주관적인 판단에 의한 것이었으며, 그로 인해 본의가 아님에도 불구하고 생략되거나 약술된 부분이 있을 수 있고 이에 대한 걱정은 여전히 남아 있다. 허영 헌법학의 계보와 계승에 관한 고찰의 始點은 당연히 허영 헌법학으로부터 시작되는 것이기 때문에, 단순한 독일이론의 수입에 그친 것이 아니라 그 연구방법까지 도입하여 이론생산적인 연구자로 평가받는 허영 헌법학의 중심적인 내용을 네 가지로 분류하여 살펴보는 것에서 출발하였다. 그리고나서 허영 헌법학의 계보를 고찰함에 있어서는 허영 헌법학의 영향을 받았고 그의 지도를 받았던 학문의 주체를 중심으로 제1세대와 제2세대, 그리고 법조인군과 그 외 연구자들로 구분하여 살펴보았다. 다음으로 허영 헌법학의 발전적 계승에 관한 고찰은 허영 헌법학의 계승으로서의 공통분모를 바탕으로 하되 각 연구자들의 독자적인 방향성과 색깔을 지니고 각자의 연구 및 활동을 전개하고 있는 후학들의 학문적 내용을 중심으로 살펴보았다. 그리고 후학들의 自省的인 고찰은 허영 헌법학의 계승이 발전적인 계승으로 평가받을 수 있도록 계속해서 노력하는 또 하나의 계기가 될 수 있었다.
Abstract
This article will be prepared for a session of “A Dialogue with the Veteran of Public Law Academic -Professor, Young Huh-”. The appearance of Young Huh' constitutional academic was a new wave of domestic constitutional academic, the wind is still being continued and has been developed in korean constitutional academics. This article is one study to examine the meaning of this existence and development. There is only one thing which I wish to tell, the standard of classification and judgement of inherited contents in this article is due to the subjective of mine as a author. For this study is starting from Young Huh' constitutional academic, first I classified the central contents of his works in four and considered them. And then I traced his academical lineage. That was determined by subject who was affected by Young Huh' constitutional academic and was under his academical guidance: the first generation, the second generation, lawyers and other researchers, and. Next, I examined with respect to progressive succession of Young Huh' constitutional academic by junior scholars. This examination was based on the academical common factors and mainly of their academic contents with their own academical direction and colors.
