정보통신기술의 발전으로 탄생한 사이버스페이스는 컴퓨터네트워크에 의해 만들어진 가상공간, 혹은 컴퓨터네트워크 그 자체로서 우리 일상생활의 일부가 되었다. 기술의 발전은 사이버스페이스 자체의 이용도를 증가시켰을 뿐만 아니라 사이버스페이스에 보호가치가 높은 자산의 축적을 가져왔으며 이에 따라 그 보호의 필요성도 증대되었다. 본 논문은 사이버스페이스를 위협 혹은 침해하는 행위들을 어떻게 규율하고 또 대응할 것인가에 대한 문제의식을 바탕으로, 그동안의 국제사회의 논의과정을 살펴보고, 국가 간의 적극적인 협조가 필요한 형사법적인 모델과 국가들 간의 극단의 견제를 전제로 하는 전쟁법적 모델을 각각 검토, 실제 사례를 바탕으로 관련 문제점을 검토하였다. 사이버스페이스의 안전한 이용 및 유지를 위해서는 사이버스페이스의 안보를 침해하는 행위들에 대해 국가들이 적극적으로 대응할 수 있도록 국가들 간의 원활한 협력체계 구축이 필요하며, 아울러 국제사회의 평화와 안전을 유지하기 위한 기존의 집단안보체제 구축노력이 사이버공간에서도 필요하다. 사이버스페이스를 규율하는 법질서의 큰 변화의 흐름 속에서, 사이버스페이스의 특성을 제대로 반영하고, 딜레마를 극복한 효과적인 법적 체계를 구축하는 것이 그 어느 때보다 시급하다고 하겠다.
Abstract
Cyberspace has become part of the routine of our daily lives, based on the advancements in information and communications technology(ICTs). Advances in ICTs not only have increased exponentially the number of peoples, using the cyberspace, but also accumulated valuable data in cyberspace. This has raised the awareness of the need to protect the cyberspace. This paper discussed how to regulate and respond to the threat or invasion of cyberspace, and covered the trends and developments in global cyber security legal frameworks. It is needed to build up a cooperative legal system among States, more positively cope with the infringement on cyberspace for the international peace and security. This paper has reviewed the trend and development of global cyber security legal frameworks from two perspectives, international cooperation in criminal justice and the law of war. It is urgent to build up effective legal frameworks to continuously maintain global cyber security in a significant change of cyberspace legal order.
