제주특별자치도 감사위원회 기능강화를 위한 제도개선 방안 -제주 감사위원회 조직현황 분석을 중심으로-

초록
제주특별자치도 출범 8년째인 감사위원회는 감사위원장의 임기보장, 일부 감사요원의 전문화 문제 등, 많은 부분에서 제도 개선이 이루어지고 있으나, 도민사회에서는 감사위원회의 독립성과 전문성에 대한 지속적인 문제 제기가 있어 왔다. 감사위원회의 현재 실질적인 조직현황과 기능 분석을 통하여 제주감사위원회의 문제점을 제기하고 그 개선안을 제시하였다. 감사위원회의 독립성을 강화하기 위해서는 감사요원에 대한 신분상 독립성과 감사업무상 독립성과 등이 필요하다. 신분상의 독립성을 위해서는 임기보장, 인사권확보 및 조직인력의 현실화 등이 필요하고, 업무상 독립성을 위하여 전문성, 감사범위의 명확성 등의 요소들이 필요하다. 제주 감사위원회의 사무국 전 직원에 대한 감사위원장의 실질적인 인사권 보장, 행정감사과․교육감사과 신설 등 조직․인원의 현실적 조정, 교육프로그램마련․인사교류 등 전문성 강화 체계 구축, 교육감사권 일원화 등 실효성 있는 개선방안으로 나아갈 때 감사위원회의 전문성 독립성 확보를 위한 진전된 제도개선이 이루어질 것으로 보인다. 제주 감사위원회의 역량과 성과는 향후 우리나라 지방자치단체의 지방감사제도에 대한 법․제도적 시금석이 될 것이다.
Abstract
Eight years have passed since the launch of Jeju Special Self-Governing Province Audit and Inspection Commission(JAIC). Some say that it seems more positive aspects of JAIC in terms of decentralization of power and local government's autonomous rights, but the criticism say that there has been still a controversy on the independence of JAIC from the start. This study aims at analyzing the function of JAIC, and suggesting some alternatives to raise the independence of JAIC. The structure and functions of JAIC should be amended to raise it's independence by transferring the control power from the governor to the chairperson of JAIC. First, it is needed to the independent right of the personnel adminstration in JAIC. Second, the recruitment system for specialists needs some changes. Third, a chairperson of JAIC must have a right to recommend a member of audit committee. In addition, reinforcement of the budget rights and a power to audit Jeju Special Self-Governing Provincial Office of Education should be empowered to enhance the independence and professionalism of JAIC.
