마리화나 정책 변화의 고찰: 콜로라도 마리화나 합법화의 경우

2014년 1월 1일부터 미국 콜로라도 주 내의 마리화나 (대마) 판매 업소에서는 일반인을 대상으로 한 마리화나 판매에 일제히 들어갔다. 콜로라도 주는 주민투표를 거쳐 주 정부 헌법을 개정함으로써 일반인이 기호용 마리화나를 합법적으로 구매하는 것이 가능하게 된 것이다. 연방 법률에서는 마리화나에 관한 일련의 행위를 여전히 불법으로 규정하고 있으나, 흡연용품 뿐 아니라 다양한 종류의 마리화나 제품이 주 내에서 합법적으로 거래되고 있다. 콜로라도 주에서는 합법화 전면 시행 이전부터 세밀한 정책을 수립하여 마리화나 유통과 판매를 관리하고 있는데, 합법화 반대론자의 주장과는 달리 현재까지 범죄율의 증가나 다른 사회적 역효과가 나타나고 있지는 않다. 본 연구는 미국 콜로라도 주에서 전면적으로 시행된 마리화나 합법화 과정과 그 후 등장한 논란, 그리고 미국의 마약 정책 변화가 우리나라 형사정책 기관에 주는 시사점을 연구한 것이다. 즉, 콜로라도 주에서의 마리화나 합법화가 우리나라와는 전혀 다른 역사와 전통, 언어와 제도를 보유한 타국의 특이한 정책 변화라고 치부하기에는 양국의 문화와 인적, 물적 교류가 적지 않다. 따라서 미국에 거주하는 한국 유학생이나 다른 형태의 체류자들의 마리화나에 대한 인식 변화나 법 의식 변화 등이 있는지에 대해서 중장기적으로 연구해 볼 필요가 있을 것이다. 또한 우리나라 법 집행 기관도 운반이나 유통이 용이한 마리화나 제품이 우리나라 마약시장에 어떤 영향을 줄 수 있는지 등 마약시장 자체의 변화 가능성도 살펴 볼 가치가 있을 것으로 보인다.
Abstract
This study examines the marijuana legalization process in the State of Colorado, USA. Specifically, this paper looks into issues that have arisen after the legalization of marijuana. Also, the implications for Korean law enforcement agencies are presented. Colorado has legalized recreational marijuana as of January 1st, 2014 by way of amending the State Constitution. Thus, it is now possible for visitors as well as people of Colorado to legally purchase recreational marijuana products in many dispensaries. Marijuana legalization is an interesting social and legal change because federal statutes in the US still forbid any kinds of behaviors related to marijuana. In other words, the federal government can intervene this change of marijuana policy in Colorado if it desires to do so. Although critics expressed concerns of violent crimes and other social harms caused by marijuana use before the legalization, the process so far has been relatively smooth in Colorado. Considering drug policies implemented in Korea so far, it is highly unlikely that marijuana becomes legalized in the near future. However, Korean government and law enforcement agencies may have to prepare for possible influx of marijuana in Korean territory. It may not be unusual to predict that behavior and perception toward marijuana will change when people spend some time in the US where residents and visitors can buy and consume marijuana products without any legal interventions. Therefore, it is worth examining how Korean students and tourists who study and/or visit the US change their behavior and perception toward marijuana. In addition, future research needs to focus on the physical and psychological harm caused by marijuana use in Korea.
