생명공학분야 특허풀의 필요성과 형성촉진을 위한 제언

특허풀(Patent pool)은 원래 제품간의 호환성이 상업적 성공의 관건이라고 할 수 있는 정보통신분야(Information technology, 이하 ‘IT’로 약칭한다)에서 주로 논의되어 왔다. 그러나 최근 유전공학기술의 비약적 발전에 따른 지식의 접근성 문제들을 극복하기 위한 방안으로 생명공학분야(Biotechnology, 이하, ‘BT’로 약칭한다) 특허풀이 제안되고 있다. 본 논문에서는 생명공학산업이 직면한 어려움을 조사하고 혁신의 장벽을 극복하기 위한 대안으로 특허풀의 활용가능성을 검토하였다. 그 결과, 특허풀은 생명공학분야에서 발생하는 문제들을 해결하기 위해 좋은 수단이 될 수 있다는 결론에 도달하였다. 다만 제품의 표준화를 통한 이윤창출이라는 공통목적을 위해 권리자들에 의해 자발적으로 결성되었던 IT 관련 특허풀과 달리 BT 분야 특허풀은 “지식재산권에 대한 접근성 제고와 공익의 증진”이라는 요소가 큰 부분을 차지한다. 따라서 IT 분야 특허풀과는 근본적으로 다른 방향에서 BT 분야 특허풀에 관한 연구를 새롭게 진행할 필요가 있다. 지금까지 국내에서도 특허풀에 대해 진행된 연구가 몇몇 있으나, 이는 대부분 IT 분야 특허풀에 관한 것이다. BT 분야 특허풀이 관련기술의 이용을 촉진시키고 기술혁신을 불러일으키는 유용한 도구가 되게 하기 위해서는 해당분야에 대한 근본적인 연구를 통한 정책제안이 필요하다.
Abstract
Generally speaking, in order to accelerate R&D and promote development of industry, it is essential to protect the related technology by patent. However, as to biotechnology, there are concerns that innovative efforts are stifled rather than fostered by intellectual property. In accordance with the rapid development of genetic engineering technology, patent tsunami, namely the rapid acceleration of patent application and issuance appears and resulted in patent thicket. The patent thicket disturbs researchers to conduct their study and can delay or limit scientific research. In order to overcome that phenomenon, some scholars suggested biotechnology patent pool. Patent pool is an arrangement between two or more patent owners to license one or more of their patents to one another or third parties. So far, patent pool has been mainly used for information technology in which standardization of the product is very important. In this article I reviewed the possibilities of biotechnology patent pool and suggested reasonable utilization of that.
