‘대향범’개념과 불가벌적 대향자의 처벌여부

초록
대향범은 대향자의 협력행위를 예정하는 범죄유형이다. 따라서 대향범의 개념요소는 대향자의 협력행위와 대향자 사이의 의사의 합치이다. 불가벌적 대향자의 협력행위도 대향범의 실행행위가 예정하는 것이다. 대향자 사이에 형법총칙의 공범규정이 적용되는가에 대해서는 대법원은 일관하여 이를 부정하고 있지만, 최소협력의 원칙에 따라 공범규정적용을 제한적으로 긍정하는 학설은 불가벌적 대향자가 구성요건실현에 필요한 최소한도를 넘어서는 행위를 한 때에는 불가벌적 대향자를 상대방 대향자의 공범으로 처벌할 수 있다고 한다. 그러나 대향범의 규정의 해석상 입법자는 최소협력의 원칙을 받아들이지 않은 것으로 이해된다. 최소협력의 원칙은 구성요건에서 개념적으로 당연히 요구되는 협력행위를 소극적 가담행위에 제한하고 이를 넘어서는 적극적 가담행위에 대해서는 공범규정을 적용하여 처벌하고자 하는 것이지만, 이는 법적 근거 없이 불가벌적 대향자를 처벌하는 결과를 낳기 때문에, 죄형법정주의 원칙에 부합하지 않는다. 불가벌적 대향자는 입법자가 처벌대상으로 삼지 않은 자라고 해석함이 타당하다. 공범규정은 1인이 범할 수 있는 범죄에 대해서 적용되는 것이다. 대향자 사이의 공범규정적용을 제한적으로라도 긍정하는 것은 대향범도 1인이 범할 수 있는 범죄임을 의미하기 때문에, 이는 대향범의 개념 자체를 부정하는 것과 다름이 없다.
Abstract
An adversarial crime is a type of crime in which an adversary’s cooperation is intended by the lawgiver. That concept involves an adversary’s cooperation and a mutual consent of adversaries. The cooperation of an unpunishable adversary is premised in the act of committing an adversarial crime. The Supreme Court has consistently decided that the provisions of arbitrary complicity should not apply to a cooperation act between adversaries, but some scholars have maintained of their opinion that an unpunishable adversary is to be punished as a complicity to the other adversary’s crime if he does the act beyond the minimum necessary in realizing the composition requirements of an adversarial crime(what is called “the principle of minimum cooperation”). This principle has no legal basis, and arrives at a conclusion that an unpunishable adversary can be punished due to the behavior which the criminal law does not regulate. It is against the principle of “nullum crimen nulla poena sine lege”. It is virtually the denial of the concept of adversarial crime itself to acknowledge that the provisions of arbitrary complicity are applicable to a cooperation act between adversaries, because such a acknowledgement almost means that an adversarial crime is what is to be committed by one person.
