변호사 간의 법조윤리에 관한 비교법적 연구

초록
한국에서는 단기간 변호사의 폭발적인 증가로 인하여 변호사의 법조윤리와 관련된 문제가 불거지고 있다. 이와 같은 상황에 대비하기 위하여 변호사를 배출하는 법학전문대학원에서는 사법시험 제도 시행 때보다 법조윤리 교육을 강화하였으나 법조윤리의 교육 내용은 주로 변호사와 의뢰인 간의 윤리에 초점이 맞추어져 있고, 대부분의 법조윤리 수업시간을 법무부 주관 법조윤리시험에서 출제가능성이 높은 주제에 할애하는 것이 보통이다. 그러나 실제 변호사 생활을 하면서 의뢰인과의 관계에 못지않게 중요한 것이 변호사와 상대방 대리인 내지 상대방 당사자와의 관계이다. 변호사는 기본적으로 상대방 대리인 및 상대방 당사자와 재판에서 다투는 사이이기는 하지만 보다 효율적이고 공정하고 신속한 재판을 위하여 협력해야 하는 관계이기도 하다. 이와 같은 변호사 상호간의 윤리의 중요성과 의뢰인의 이익의 조화 때문에 세계 각국에서는 변호사 상호간의 윤리에 대하여 명문의 규정을 두어 규율해 왔다. 그러나 우리나라에는 변호사 상호간의 윤리에 대한 명문의 규정이 없고 변호사윤리장전에서 관련 내용을 일부 제시할 뿐 사실상 그 구체적인 내용은 변호사 개인의 인격과 품행에 맡겨두고 있다. 본고에서는 우리나라의 현행 변호사 관련 규정과 ABA, 일변련, CCBE의 윤리규정 등을 비교 검토하면서 그동안 다른 법조윤리 주제들에 비하여 상대적으로 등한시 되었던 변호사와 상대방 대리인 간의 법조윤리에 대하여 비교법적으로 검토해 보고자 한다.
Abstract
There are many problems of Legal ethics in Korea due to the heavy increase of Lawyer in short period of time. Law schools in Korea prepared for these problems by reinforcement of Legal ethics education, however, the course focus on Client-Lawyer relationship and most of times are alloted for the subjects which have the high examination question trends. Nevertheless, Lawyer-Lawyer relationship is as important as Client-Lawyer relationship in the field. Although lawyers are in dispute with opposing party and counsels, but also should cooperate with them for the fair trial and expediting litigation. For such a reason, various countries of the world regulated the legal ethics between lawyer by substantive enactment. Korean legislator didn't expressly stipulated the legal ethics between lawyer in the text though, only the ethic code for attorneys of Korean Bar Association glimpse about it and most of practice leave each lawyer's personality and conduct. The writer of this article make a comparative study for the legal ethics between lawyer which was neglected than other subjects of Legal ethics by comparing Korean regulation for lawyer with the regulations of other countries.
