한국에서 빅데이터를 둘러싼 법적 쟁점과 제도적 과제

This article a brief review of the status of Korea’s big data policy and legal and institutional issuessurrounding big data. As many IT experts have pointed out hardware was developed first and then software in the ICTdevelopment process. Thereafter, the technology to accumulate and analyze big data is expected tocontinue to develop in the future unless unexpected events happen. The flow of big data is not expected to affect only one field of technology but every aspect ofan individual’s daily life and thus the entire paradigm of relevant industries and the nation’s managementwill be altered in the end. Under these circumstances, laws and institutions related to bigdata must be revised or reviewed to strengthen the competitiveness of Korea’s big data industry. Ofcourse, as this issue is closely related to protection of personal information or privacy which is animportant value in society, it is not easy to find a solution. The issue should be resolved after concludingwhether Korea’s cultural DNA puts more emphasis on increasing social values throughsmooth flow of information than on the right to privacy as self-determination rights. However, in order to arrive at a more desirable conclusion on this issue, members of societymust think carefully about the essence of the issue before participating in public discourse based ontheir own political orientation, and then make joint efforts to reach a harmonious conclusion in the community.
