공공데이터 활용을 위한 개인정보보호 제도의 개선 과제

As the utilization of public data based on the outcomes of national informatization which is implementedas a national policy is increasingly being highlighted in our society, it is true that expectationsof specific outcomes are growing. After enforcement of law related to providing publicdata that enabled legal usage of public data and vitalizing usage, it did not only simply provide andopen data to develop specific and high utilization service but also a series of concerns was raisedthat there is a need of improvements of system to a form that broadens “data availability”. Especially, amid increasing requests of utilizing public data including personal information to develophigh-quality service, problems of expanding availability of public data can be resolved dependingon how to judge conflicts between freedom of information that can be a ground for using publicdata and self-determination right of personal information that is ground for personal informationprotection. We looked at the specific improvement tasks of utilization of public data and personalinformation protection law system to determine availability of public data which is personal informationthrough a process of resolving the conflict issues of two fundamental rights to achieveeffectiveness of improvements of life quality and economic developments by utilizing the public data.
