협동조합기본법상의 자치성에 관한 소고

초록
2012년 협동조합기본법이 제정된 이 후 2014년 현재까지 4652개의 협동조합과 150개의 사회적 협동조합이 설립되었다. 협동조합은 자본주의에 대한 새로운 대안이자 세계경제의 활성화를 위한 대안으로 인식되면서, 2009년 UN(United Nations)은 2012년을 세계협동조합의 해(International Year of Cooperatives)로 지정하였다. 우리나라의 경우 협동조합이 내재하고 있는 경제발전의 대안으로서의 장점을 인식하고, 기존의 8개 특별법을 제외하고 2012년 협동조합기본법을 제정하였다. 협동조합의 태동의 목적은 사회적·경제적 약자들의 경제적 자립과 자유를 위해서이다. 그리고 중요한 가치는 사회적·경제적 약자들을 돕고자 협력하는 협동조합적 연대의 형성과 설립이다. 우리의 협동조합의 태생이 국가에 의한 하향식 설립이 기반을 이루고 있어, 자발적이고 국가와의 경쟁과정을 통해 상향식으로 성장을 하여왔던 외국의 협동조합법과는 매우 다르다. 그러나 우리의 경우 향약, 두레 등의 고유한 상부상조의 문화가 자리하여 왔었다. 즉, 우리의 민족성에는 상부상조에 대한 지양이 그 토대를 이루고 있어서, 협동조합의 발전을 위한 기초는 충분하다고 보아진다. 협동조합의 경우 자치성의 확보가 매우 중요하다. 자치성의 확보는 자본의 자치와 정관자치를 통해 나타난다. 이에 스페인, 미국, 프랑스 ,이탈리아의 협동조합법제와 협동조합의 운영 등에 대해 검토하여야 한다. 자치성 확보에 대한 검토를 통해 우리의 협동조합기본법이 내재하고 있는 문제점을 파악하고 개선방법에 대한 연구가 이루어져야 한다. 이러한 연구를 통해 협동조합 7대 원칙과 우리의 문화적, 경제적, 사회적 전통이 내재된 협동조합으로 지속 가능하며 발전을 이룰 수 있을 것이다.
Abstract
Framework Act on Cooperatives was enacted in 2012. Afterwards, until 2014 presently, 4652 cooperatives and 150 social cooperatives have been established. Cooperative has been recognized as the new alternative of capitalism and the means to vitalize world economy. In 2009, UN(United Nations) appointed the year 2012 as International Year of Cooperatives. The purpose of beginning of cooperatives is for financial independence and economic freedom of the social·economical weak. And important value is the formation and establishment of cooperative solidarity which cooperates to help the social and economical weak. The origin of our cooperatives is based on the downward establishment by the nation. Therefore, ours is quite different from foreign Act on Cooperatives, which has achieved growth upwardly through spontaneous act and competition process with the nation. However, in our case, intrinsic culture of mutual help, e.g. Hyangyak, Doore, etc. have already been established. That is, in our ethnicity, tendency of mutual help has established its foundation, so that the basis for development of cooperatives is enough. First, this research investigated the types of our cooperatives, operation, and commerciality. And this research aimed at examining legislation of cooperatives of Spain, U.S., France, Italy, and the operation of cooperatives, etc. Through this examination, this research intended to comprehend the problems in our Framework Act on Cooperatives. Also, researches on the improvement plan should be performed. Through such researches, development of cooperatives can be created to be sustainable ones in intrinsic type which includes 7 principles of cooperatives, and in which our cultural, economic, and social tradition are inherent.
