진화생물학적 관점에서 바라본 형사법체계

Evolutionary biology is a sub-field of biology concerned with the study of the evolutionary processes that produced the diversity of life on Earth. Evolutionary biology is a conceptual subfield of biology that intersects with other subfields that are delimited by organizational level, for example cell biology, population biology, taxonomic level or angle of approach, for instance, field biology, theoretical biology, experimental evolution, paleontology. Usually these intersections are combined into specific fields such as evolutionary ecology and evolutionary developmental biology. It unites all the fields of biology under one theoretical umbrella. The impression of it being a soft science is reinforced when biologists in unrelated fields speculate publicly about evolution. And some evolutionary biologists aim at consilience of all domain of knowledge. This tendency of the interdisciplinary approach will or should meet with criminal law system. but these field has not been gone deep into, until a recent date. So in this study aim to consider criminal law system from the evolutionary biological point of view carefully. Especially focus is that: what is the human nature and that exists in common. if the human nature exists, how does that influence for moral sense of human, social norm and criminal law system. Finally, the orientation of the criminal system by biological evolution approach is essentially concluded with recovery of the human nature and such a conclusion would have to be absorbed by the various policies.
