최근 주요 쟁점과 관련한 통신비밀보호법 개정방향

This article discuss the current issues on the intrusion of the communications secrets, especially interception of cellular phone communications, packet inspection, collection of base station or GPS location information, and offer the direction of reforms in Electronic Communications Privacy Law(ECPL). The main revision direction of Electronic Communications Privacy Law may be summarized as follows. (1) The interception of mobile communications by strengthening the obligations of communications service providers to cooperate with law enforcement agencies in having private communications eavesdropped cannot be supported before reorganization of ECPL. The reduction of wiretapping list should be ahead of that revisions. (2) To prevent the invasion of privacy and the abuse of law enforcement agencies, the approval procedures of court and execution procedure of investigative agency should be strengthened and become transparent. (3) In connection with the collection of base station or GPS location information, the requisites for collection of that information and strict formal legal processes should be newly created in ECPL.
