For cope with new form of criminals, Republic of Korea establish the basisregulation of Seize and Search toward digital evidence, Act 106 Term 3 & 4through Criminal procedure code law reform on July 18, 2011. However,according to criminal procedure code law Act 106 term 3 & 4, Republic ofKorea can print or output saved digital evidence data from the computer orthe data storage media. And if its impracticable or exceptional, Republic ofKorea regulate to seize the computer or the data storage media. Thisregulation is introduce from a traditional criminal work into the legislation. But working-level office and academia request a new legislation or reformthe regulation. Because current regulation itself, cannot solve every problemsduring the seize and search a digital evidence. Those related research demand a new legislation, but cannot suggest aconcrete legislation. also, their new legislation amendment is to fragmentarysolve of existing regulation problems. Even though, these researches provideor introduce foreign legislations, but it only suggest fragmentary regulations. Therefore, this manuscript is to look for a suggestion of solve the problemon Republic of Korea legal system, though definite and minutely study of UKand US legal system related with seize and search digital evidence. Insteadof introduce more foreign seize and search digital evidence regulations.
