비전형상표로서의 디자인적 요소를 포함한 상표에 관한 법적 고찰

초록
상표법과 디자인보호법의 보호대상 및 보호의 권리범위는 상이하나, 유기적인 관련을 맺고 있다. 특히 마케팅의 변화와 발전에 따라 디자인적인 요소를 가지고 있는 표지에 대하여 이를 상표로서 인정하여 상표의 범위가 넓어짐에 따라 상표로서 인정되는 표지의 상표법과 디자인법의 중첩을 어떻게 고려하여야 할 것인지에 대한 논의가 존재한다. 디자인적인 요소가 추가되는 유형의 상표 유형의 도입되면서 상표의 범위는 더욱 넓어졌다. 상표법 및 디자인보호법상에서의 상표권과 디자인권에 대한 기본적인 비교를 통하여 그 의미를 명확히 하고, 이후 상표의 유형에서의 디자인적인 요소가 강한 표지에 대한 상표로서의 인정과 관련하여 상표로서의 인정 시 고려하여야 할 부분 중, 기능성요건에 대한 판단과 사용에 의한 식별력에 대한 판단에 대해서 고찰하고자 한다. 또한 디자인적 요소를 포함하고 있는 상표의 유형과 관련한 해외의 사례를 분석함으로서, 위와 같은 논의의 분쟁 사래에서 어떠한 논의가 이루어졌는지를 확인하고 이에 따른 시사점을 정리하여 보고자 한다. 디자인적 요소가 포함된 상표의 인정은 마케팅의 기술의 변화와 권리의 수요의 변화에 따른 새로운 흐름일 수 있으나. 지식재산권으로서의 상표권의 본질까지 변화되어서는 안 될 것이다.
Abstract
The scope of the protected trademark and design is different, but it has relationship. In particular, because of the change and development of marketing, the marks which has design elements increase in number. Currently, these marks are being recognized trademark. There are discussions about whether you should consider how the superposition of trademark and design law. Introduction of the trademarks that have design elements, the scope of the trademark is broadening out. Through the basic comparison of trademark right and design right, this article want to clarify the meaning of the trademark and design. After it considered in the recognition as a trademark which has design elements. In particular, it will consider of “functionality doctrine” and “distinctiveness by use”Also, it analyzes the case of overseas regarding the type of trademark that contains design elements. Those discussions could look for suggestion. Accepting the trademarks which contains design elements is the new wave of changing marketing strategy and demand of rights. But it should not change of essence of trademark right.
