신상결정 대행에 있어 싱가포르 정신능력법의 시사점

초록

정신능력에 결함이 있어 스스로 의사결정을 하지 못하는 사람들을 보호하는 한 편 그들의 자율성도 존중하는 것이 개정된 우리 민법을 포함한 현대 성년후견제도가 추구하는 이상이다. 특히 임의후견제도와 민법 제947조의2는 신상의 영역에서 피후견인의 의사를 존중할 것을 강조하고 있다. 후견인의 보호와 자율성 존중의 균형은 의사결정을 행하는 시점에서 요보호인의 정신능력이 어떠한 상태인가를 파악하는 데에서 출발해야 할 것이다. 또한 신상의 영역에서는 요보호인의 의사결정이 객관적으로 합리적이지 못하다 하여도 최대한 그의 의사를 존중하여야 할 필요가 있으므로, 신상결정대행에 있어서는 후견인의 권한이 여타의 행위에 비하여 신중하게 행사되어야 할 필요가 있다. 영미법계 후견제도의 전통을 충실히 따르고 있는 싱가포르 정신능력법은 다음과 같은 점에서 우리 성년후견제도에 시사하는 바가 있다. 첫째, 정신능력법은 요보호인의 정신능력이 시간의 흐름에 따라 변동할 수 있음을 인정하고 정신적 무능력의 상태를 유형화하는 한편 정신능력의 감정이 수시로 행해질 수 있도록 절차적으로도 정비하였다. 둘째, 정신능력법은 재산사무 대리인(property &affairs donee)에 대응하는 신상행위 대리인(personal welfare donee)의 개념을 두어 임의대리인의 사무를 크게 둘로 나누는 한편, 요보호인의 신체구속행위와 중요한 의료행위에 관해서는 법정후견인가 임의후견인가를 불문하고 후견인의 의사결정권한을 극히 제한하고 있다. 본고는 이와 같이 싱가포르 정신능력법의 개관을 통하여 우리 법제도에 유익할 만한 사항을 검토하면서, 특히 의사결정무능력자의 ‘무능력’을 감정함에 있어 적용되는 일반적 기준을 더욱 자세히 소개하고자 하였다.

Abstract

It is consequently necessary to protect the adults who have difficulties in making their own decision because of a lack of mental capacity, which should however be attained without infringing their autonomy and freedoms. The new adult guardianship system in Korea intended to respect dignity and human rights of mentally incapacitated adults, to guarantee their autonomy and to minimize the public interventions for assisting them. So the reformed protection system introduced a continuing power of attorney. Furthermore, according to section 947-2, people who lack mental capacity can make decisions by himself on their personal welfares. However, Korean Civil Code for instance does not provide for any guidance as to how the capacity of adult to make such decisions can be assessed. So there are two questions: how can a guardian respect a mentally incapacitated adult and also protect him if his capacity cannot be properly assessed? And how can he identify the personal welfares separately?So this article explains the main features and contents of the Mental Capacity Act 2010 of Singapore. Under the Act, adults must be assumed to have capacity unless it is established that they lack capacity. And Mental capacity is assessed on a case-by-case basis and cannot be assumed based only on the person suffering a particular medical condition. Furthermore, a person’s lack of mental capacity cannot be based only on age, how a person looks, his condition or any aspect of behaviour. A person lacks a capacity to make his own decision if he is unable to understand the information relevant to the decision, to retain that information, to use or weigh that information as part of the process of making the decision, or to communicate his decision through any means. And a Lasting Power of Attorney(LPA) in Mental Capacity Act Singapore, allows a person(known as donor) to voluntarily appoint one or more persons(known as donee). And there are two kinds of decisions donee can make, one on personal welfare matters of mentally incapacitated adult, and another on his property & affairs matters. Mental Capacity Act places strict restrictions when donees make decisions on personal welfare matters, for example, consenting or refuse life-sustaining treatment, receiving treatment for change of gender, consenting or revoking consent to treatment for sexual sterilization, consenting or revoking consent to abortion, registering or withdrawing an objection regarding the removal of an organ from any person upon death, making or revoking an advance medical directive. And these restrictions refer also to deputies. In thess respects, the Mental Capacity Act 2010 of Singapore can be a good example which the new adult guardianship system in Korea can refer to.
