중등학교 법 교육을 위한 우리나라 현행 헌법의 핵심적 가치‧원칙 체계 이해

This article was devised to help secondary school teachers in teaching about the Constitutional System of South Korea. It performs three steps of work. Firstly, it extracts analytically the core values and main principles from the text of the Constitution. Secondly, it investigates the logical sequence and the axiological hierarchy among those values and principles, and rearranges them according to such sequence and hierarchy. And finally, it schematically proposes the structure of those values and principles as a consistent and coherent system with some operative mechanism. Conclusively, it points out two aspects of the System. The one is that the System is coherently and rationalistically woven with the values and principles which were originated complexly from the philosophy of Enlightenment(liberalist theory of the Natural Rights, republican idea of the Social Contract, and the constitutionalist thought of limited government), the twentieth century welfare-statism(rejection of both socialism and laissez-faire capitalism), the twentieth century Korean Nationalism, and etc. The other is that the System as a whole aims for ‘a rationalistic commonwealth of human rights'.
