In the age of big data, the revelation of personal information makes it extremely convenient for the criminals to collect personal circumstances, behavior, social networks and other information which help them forming a intuitive, three- dimensional, systematic and comprehensive understanding of the dupe, consequently, telecommunication fraud is getting increased and this trend has become more and more intensified which is difficult to suppress. However, due to the lack of prospective considerations about the outbreak of telecommunication fraud in the era of big data, and the system deficiencies in protecting people’s legal right, the society once again fall into a predicament in the punishment and prevention of telecommunication fraud crime. Telecommunication fraud crime shows the features of cross-border and transnationalization, so the international cooperation and judicial assistance on the prevention and punishment of the telecommunication fraud should be put on the agenda as soon as possible.
