고등학교 '법과 정치' 교과서의 분석과 개선 모색-국제법 분야-

이 논문은 현재 고등학교의 법교육의 중심과목인 「법과 정치」교과서 중 국제법 분야에 관한 내용 분석을 목적으로 작성되었다. 국제법은 「법과 정치」과목중 “국제사회의 법과 정치” 단원의 약 절반을 차지하며 강의되고 있다. 시중에 발간된 3종의 「법과 정치」 교과서를 분석한 결과 학생들에게 국제법에 대해 지나치게 부정적이고 회의적인 인식을 줄우려가 높음이 공통적으로 발견되었다. 국제법의 긍정적 기여나 역할에 대한 설명 못지 않게 이의 한계를 강조하는 부정적 서술이 적지 않았다. 이 같은 교과서를 통해 공부하는 학생들로서는 국제사회란 물리적 폭력이 우선하는 무질서한 사회이고, 국제법은 실질적 역할을 하지 못하는 무기력한 존재라는 인상만을 받지 않을까 우려되었다. 「법과 정치」교과서 국제법 분야의 또 다른 심각한 문제점으로는 잘못된 설명이나 부적절한 설명이 적지 않다는 사실이었다. 오류의 내용은 수치나 연도 착오와 같은 단순한 오류도 있었으나, 국제법에 대한 필자들의 지식의 부족에서 비롯된 오류도 적지 않았다. 그리고 오류라고까지는 할 수 없어도 부적절한 설명이나 사례제시도 많았다. 이는 현재 「법과정치」교과서의 제작과정에 참여하는 필자나 감수위원들 중에 국제법 전공자가 전혀 없기때문에 발생하는 문제점이라고 보였다. 「법과 정치」교과서 국제법 분야의 오류 발생을 방지하고 질적 개선을 도모하려면 무엇보다도 교과서 제작과정에 국제법 전문인의 참여가 필수적이다. 교과서 제작에 전문인들의 참여를 유도하기 위해서는 집필자들에게 적정한 수준의 경제적 보상이 보장될 필요가 있다. 고등학교 현장에서 보다 질 좋은 국제법 교육이 이루어지려면 관련 교육자료의 생산이확대되어야 하며, 현직 교사를 위한 직무연수의 기회가 확대되어야 할 것이다.
Abstract
The purpose of this Article is to analyze the contents of international law part in the high school textbooks of 「Law and Politics」. 3 kinds of textbooks are currently published for the high school course of 「Law and Politics」. At first it should be pointed out that international law is described negatively too much in all 3 textbooks. Its role in the international relation is explained skeptically rather than positively. It is worried that such description would give high school students negative impression about international law too much. Secondly, author was surprised at finding that a lot of errors in contents and inappropriate or false explanations concerning international law are included in all 3 textbooks. Why are many errors or false explanations included in the textbooks? Main reason seems that no international law experts participated in making textbooks so far. For making better textbook followings are suggested: ① The high school textbooks be written by experts at each field, including international law. ② Text books be regularly reviewed by experts at each field. ③ Appropriate economic rewards be guaranteed for the textbook writers. ④ Experts should participate in making the Governmental guideline for textbooks.
