변호사의 변호과오와 배상책임보험의 의무화

전문적인 직업인으로서 법률서비스를 제공하는 변호사가 업무수행 시 의뢰인이나 제3자에게 손해를 야기하는 경우의 수가 증가하고 있다. 특히 문제가 되고 있는 것은 변호사가 의뢰인으로부터 사건을 수임하여 위임사무를 처리하는 중에 변호과오로 인한 손해발생의 문제이다. 일반적인 과실과 다른 개념으로서 변호과오는 다양한 유형으로 나타나고 있다. 소송준비를 하는 중에 발생할 수 있고, 소송이 진행되고 있는 과정에서도 발생할 수 있으며, 소송영역이 아닌 변호사업무 전반적인 사안에 있어서도 발생가능성이 있다. 변호사의 변호과오로 인하여 손해를 당한 의뢰인이나 제3자는 직무상 과오를 원인을 제기한 변호사에게 손해배상청구의 소송을 제기하게 되는 상황이 발생하게 될 것이다. 본 논문은 변호사배상책임보험의 가입에 대한 필요성을 연구하고 있다. 일본이나 우리나라는 변호사의 변호과오에 대한 소송이 그리 많지 않으나, 미국이나 독일 등 주요 서방국가들은 ‘소송 내 소송’으로서 소송의 한 분야로 자리 잡고 있는 상태이다. 일반 법과대학에서 사법시험을 통하여 법조인을 양성하는 시스템 대신에 다양한 영역에서 경쟁력 있는 법조인을 양성한다는 취지에서, 우리나라는 2009년 법학전문대학원 체제가 도입되었다. 법조인의 수는 대폭적으로 증가하였고, 법조인 인구의 증가는 우리나라 법조시장에서 다수의 변호과오소송을 볼 여지가 없는 것도 아니라고 하겠다. 변호과오로 인한 변호사의 위험을 보험회사에게 전가할 수 있는 변호사배상책임을 도입해야 할 필요성이 있다. 더 나아가 보험이 존재함에도 불구하고 임의적인 사항으로 인하여 변호사배상책임보험의 가입비율이 저조하다. 변호사배상책임보험의 실질적인 강제화 필요성이 있다고 하겠다.
Abstract
