일본의 “개인데이터 이용에 관한 제도개정” 제언에 관한 고찰

초록
일본 정부는 2013년 6월에 “세계최첨단 IT국가 창조 선언”을 결의하게 된다. 그 선언을 통해 일본 정부는 big data 중 이용가치가 높다고 기대되는 개인정보의 취급에 대해 활용을 위한 사업환경 정비를 진행하였고, 일본의 개인정보보호법에 대한 개정검토를 하였다. 이에 따라 2014년 6월 24일 개인데이터의 이용에 관한 제도를 개정하고자 하는 내용을 발표하게 된다. 이 발표로 인하여 일본은 학계와 경제계 및 사회단체에서 활발한 논의를 하고 있다. 이를 통해 개정안이 발표될 예정이다. 우리나라의 경우 현재 시행되고 있는 개인정보호보법은 기존 관련 법령과의 체계적인 정합성이 문제와 SNS, big data, 클라우드 컴퓨팅으로 인한 개인정보의 위협 등 기존 개인정보보호법으로는 역부족이라는 점 등을 이유로 법 제도의 정비가 필요하다는 지적이 있어왔다. 따라서 본 논문은 이러한 관점에서 일본의 개정제안을 고찰함으로써 우리나라가 제도 정비를 할 때 어떠한 시사점을 얻을 수 있는지를 살펴보았다.
Abstract
The Japanese Government has determined “the Declaration of creating the most advanced IT nation in the world’ on June, 2013. With the declaration, the Japanese Government has progressed to repair service environment for a personal data that is considered at high value of big data, and reviewed to revise the Personal Data Protection Act in Japan. Accordingly, the Japanese Government has announced the issue to revise the system for use of a personal data on 24th of June, 2014. Since this issue, this topic has been heavily discussed by the academic, political and economic fields and social organization in Japan. With this, a revision is planned to be issued. In Korea, there have been comments about the revision of the Personal Data Protection Act, Act No. 11990, because the Personal Data Protection Act is not enough to protect the personal information due to the systemic problem of a state of equilibrium between the Personal Data Protection Act, SNS, Big Data and Cloud Computing. Therefore, this article examined that when a personal data protection system will be revised, which suggestions we can get, as considering the revision proposal of Japan.
