우리나라는 1970년이후 고도 경제성장과 더불어 인구의 도시집중화가 이루어지고 있다. 도시를 지속가능한 개발하여 환경과의 조화가 이루어지도록 하는 것이 요구되고 있다. 더욱이 최근에는 국가와 지방자치단체는 도시의 건축물에 대한 고층화 또는 수직화를 허용함에 따라 인근건물의 신축으로 인한 일조권침해의 문제가 주거지역에서 상업지역에로까지 확대되어 법적분쟁이 증가함에 따라 상업지역내에서 주거일조권의 법리의 필요성이 요구되고 있다. 그동안 주거지역에 대한 주거 일조권을 보호하기 위하여 건축법등에서 명문으로 인정하고 있고, 수인한도론에 의하여 그 일조권의 법리가 판례와 학설이 정립되어 왔다. 그러나 상업지역에서의 주거일조권에 대한 일조이익의 법적 보호 요건 등의 일조권법리에 관하여 논의조차 없는 상태이고 판례에서도 상업지역의 경우 주거지역보다 달리 판단하여야 한다면서도 상업지역상의 주거에 대한 일조권의 인정범위와 그 피해보상의 기준이 정확히 확립되어 있지 않다. 따라서 상업지역에서의 거주 일조권의 개념과 법적성질을 살펴본 후, 우리나라의 상업지역에서의 주거 일조권의 판례동향을 분석한다. 더 나아가 상업지역에서의 주거일조권에 대한 개인적 공권 인정문제, 법적보호의 요건 문제, 일조권 향유주체 문제, 환경영향평가 등에서의 일조 보호기준과 건축법령상 상업지역의 일조보호를 위한 객관적 기준 신설문제, 환경분쟁조정위원회의 일조침해에서의 구제범위 확대 문제, 행정개입청구권과 국가배상책임 인정문제 등의 법적과제를 검토하여 상업지역내 주거 일조권 분쟁을 최소화하고 신속하게 권리구제를 받을 수 있는 방안을 찾는다.
Abstract
Urban concentration of population has been achieved with high growth of economy in Korea since 1970. Sustainable development of urban areas and their harmony with environment have been required. Moreover, as nation and local governments allow high-storied or vertical construction of urban buildings, issues of violation of right of light have been extended to commercial areas from residential areas due to new construction of neighboring buildings, legal conflicts have also increased and finding the legal principles of right of residential light in commercial areas has become a social issue. Right of residential light has been protected by construction law and precedents and theories on the legal principles of right of light have been established by theory of acceptance limit. But, there has been no discussion about right of residential light in commercial areas and recognition range of right of residential light in commercial areas and standard of its compensation are not clearly established. Therefore, this study analyzed the precedents of right of residential light in commercial areas after concept and legal property of right of residential light in commercial areas are examined. Besides, it examined legal tasks such as recognition of individual civil rights for right of residential light in commercial areas, requirements of legal protection, and subject of enjoying right of light, protection standard of light on environmental impact assessment, creation of objective standard for protection of light in commercial areas on construction law, extension of remedy range in violation of light by Environmental Dispute Resolution Commission, request for administrative intervention and recognition of state compensation and sought the methods to minimize the disputes of right of residential light in commercial areas and have rapid protection of right.
