Resolving Trade Secret Disputes in China: Alternative Dispute Resolutions available for Foreign Investors

Due to remarkable growth of economy and the inflow of foreign direct investment in China, the issue of protecting intellectual property has become increasingly serious for foreign businesses in the Chinese market. According to the recent survey, protection of trade secrets remained as the top priority concern for foreign companies. Therefore, dispute resolution for trade secret infringement case is becoming critical issue to the foreign investors as well. However, China and the developed economies have different dispute resolution system due to political, ideological, cultural and historical difference. Due to their difference of legal systems and conventions, foreign investors have to determine how to resolve in a successful way whenever the trade secret disputes come about. This research paper will identify various dispute resolution methods and recommend probable ways to reduce and resolve trade secret disputes.
