환황해권 경제협력 강화를 위한 한중경제협력단지 조성과 법제지원 방안
Making Korea-China Economic Cooperation Area and Legislative Measures to Support Strengthening Pan-yellow Sea Area Economic Cooperation

최근 한국과 중국의 경제협력방안에 대한 논의가 활발히 진행되고 있다. 특히 올해 7월 시진핑 중국 국가주석이 방한한 후로, 새만금에 한중경협단지 건설에 대한 논의가 급물살을 타고 있다. 이에 한국과 중국은 새만금 한중경제협력단지가 양국의 경제협력 및 투자의 핵심 거점으로 성장할 것으로 기대하고 있다. 한편, 중국은 황해에 인접해 있는 산동성을 중심으로 한국, 나아가서는 일본과의 경제협력을 위한 한중일 경제협력 시범지역 건설을 위해 빠르게 움직이고 있다. 이로써 환황해권 경제협력을 위한 양국의 초석이 마련되었다. 이러한 양국의 경제협력이 보다 효율적, 성공적으로 이루어지기 위해서는 제도적 기반을 다지는 것이 가장 중요한 문제 일 것이다. 중국은《산동반도 남색경제구 중일한지역경제협력 시범구 설립을 위한 기본방안(在山东半岛蓝色经济区建设中日韩区域经济合作实验区的框架方案)》을 마련하고, 시범단지에 대한 기본 정책을 세웠다. 아직 시(市) 단위로 이루어지는 한중경협단지에 대한 구체적인 실시조례는 마련되지 않았지만, 각 지방정부와의 협의가 활발하게 이루어지고 있는 상황이다. 반면, 새만금 한중경협단지에 관해서는 한중 양국이 단지 조성에만 의견을 같이 하였을 뿐 아직 양해각서를 체결하는 등 정부차원의 협의서를 작성하지 못하였다. 이러한 시점에 환황해를 사이에 두고 이루어지고 있는 한중 간 경협단지 조성 현황을 살펴보고, 성공적인 협력이 이루어지기 위한 법률지원 방안에 관해 개괄적으로 논의해보는것은 환황해권 경제협력 강화에 매우 의미 있는 연구가 될 것이다. 따라서 본 논문에서는 우선, 환황해권을 중심으로 한, 한중경협단지 조성 배경에 대해 살펴보고, 다음으로 양국의 경제협력지역 조성과 관련된 정책 및 제도를 산동성 남색경제구를 중심으로 검토해 본다. 마지막으로 새만금 한중경협단지의 성공적 조성을 위한 법률지원 방안에 대해서 개괄적으로 고찰해 보도록 한다.
Abstract
Recently, the plan for Korea-China economic cooperation(KCEC) is being discussed actively. Particularly, after Chinese President Xi Jin Ping visited Korea on July of this year, the lively discussion of proposal to build KCEC area in Sae Man Geum of Korea is taking place. Both of Korea and China is expecting that Sae Man Geum KCEC area will grow as a core stronghold of economic cooperation as well as investment. Meanwhile, China is making an effort to build the demonstration areas for Korea-China-Japan economic cooperation in San Dong which adjoins the Yellow sea. Hereby, the pillar of both con tries for making the pan-yellow sea area economic cooperation has been prepared. In order to succeed in economic cooperation further efficiently, the establishment of institutional foundation is more likely to be an important matter. China determined fundamental policy for the demonstration area based on 《A Basic Plan to Build the Demonstration Area for China-Japan-Korea Regional Economic Cooperation in San Dong Blue Economic Area(在山东半岛蓝色经济区建设中日韩区域经济合作实验区的框架方案)》. Even though the specified implementation law applied to KCEC area is not yet legislated, the discussion about it is already in progress between the local governments of both countries. With the regard to Sae Man Geum KCEC area, on the other hand, they only shared the common view, but not conclude any agreement between the governments. Under the circumstance, not only to understanding the current situation of the economic cooperation between the countries, but also to discuss the legislative supporting method would have significant implication in order to strengthen pan-yellow sea area economic cooperation. Thus, this paper overviews recent development of KCEC areas around the pan-yellow sea at first. And then it researches the economic cooperation related policies and legislations of both countries focused on those of San Dong Blue economic area in China. Finally, it analyzes the supporting methods in legislation and policy in order to build KCEC in Sae Man Geum successfully.
