인터넷 가버넌스와 데이터보호의 갈등조정을 위한 국내법 체계의 개편방향모색

‘인터넷 가버넌스’에 대한 국제 사회의 오랜 논의는 인터넷에 대한 규칙제정을 목표로 노력했다고 평가할 수 있다. 그러나 각국의 규제철학과 고민, 이해관계를 융통성있게 반영하기 위해서라도 획일적 강제규칙의 신속한 제정이 아니라 시민단체, 인터넷 기업 등 다양한 이해집단이 참여하는 합리적이고 융통성 있는 ‘규칙제정절차’가 더 중요시되지 않으면 안되며, 2014년 4월의 브라질 NETmundial 회의는 다자간참여구조 ‘절차’(process)에 대한 원칙들을 천명함으로써 이점을 강조한 바 있다. 한편, 2013년 미국 정보기관의 인터넷 도감청 폭로이후 OECD는 인터넷 사업자는 데이터의 위치와 관계없이 개인 데이터에 대해 책임을 져야 한다는 권고안을 발표하였고, EU역시 2012년 1월에 첫 선을 보인 데이터보호규칙안 (Data Protection Regulation)에서 더 강력한 보호규제를 국제사회에 요구하고 있다는점 등을 감안할 때 우리의 개인데이터보호법제는 현행 인터넷 가버넌스 논의구조속에서 실체법적으로는 적어도 현행 유지 내지 보호를 강화하는 방향으로 방향을 설정함이 타당하다. 다만 EU에 비해서도 더 강화된 타율규제 부분만큼은 수정됨이 요구된다.
Abstract
International debates and everlasting discussions concerning 'internet governance' issues have been targeted mostly the 'rules setting for internet'. However, reasonable and flexible processes rather than the substantive rules themselves in dealing with such issues, considering each country's different regulation philosophy, own concerns and thoughts, should be evaluated more, which is also stressed at the 2014 Brazil NETmundial Conference. However, after disclosure of CIA's global internet surveillance activities in 2013, OECD announced a recommendation, based on the 1980 Guidelines, which requires that the data controller should be responsible for the data protectionregardless of data locations. And EU Commission also announced a new binding regulation draft which requires strengthened protection mechanism for all EU countries. So, Korea's current data protection laws and regulations should be kept at least as 'status quo' or revised for more protective way toward data storage, processing and transmission activities.
