미합중국 수정헌법 ‘제2조’와 법의 지배원리에 의한 정당화사유의 역사성과 근거

미국수정헌법 제2조와 법의 지배원리에 근거하여 형법에서 소극적 규정에 대하여 정당성을 인정하게 되는 개념은 ‘정당화사유(Justification), 면책사유(Excuse)’라고 할 수 있다. 미국 헌법 전문과 수정헌법 제2조에 근거하여 형법이 정당성을 확보하였다면 수정헌법 제2조가 가지고 있는 그 법적 근원이 무엇인가? 에 대하여 생각하여야 할 것이다. 이 부분이 다이시(Albert. V. Dicey)의 법의 지배원리와 형법의 역사성에 있다고 보고,제2장에서는 수정헌법 “제2조 [국민의 무장권]와 법의 지배원리(The Principle of Rule of the Law)에서 소극적 규정의 긍정판단의 기준이 될 수 있는 정당화사유 또는 면책사유의 근거내용에 대하여 살펴보았다. 제3장에서는 수정헌법 제2조에 근거하여 형법에서 정당화 면책사유가 인정되고 있으므로 그 법적 근거를 서양고대법에서 찾으려는 시도로 고대법을 살펴보았다. 그리하여 고대법에서 형법이 인정하고 있는 보편타당한 정당화사유와 면책사유의 이론을 정립하는 데 직접조문 또는 그 내용을 간접추정할 수 있는 ‘우르남무 법[the Laws of Ur-Namma (2100 B.C.)], 함무라비 법전[Code of Hammurabi (1795-1750 B.C.)], 이집트 법, 구약성서(the Old Testament), 고대 아테네의 법률, 로마법 등에 대해서 간략하게 살펴보았다. 제4장에서는 정당화 사유의 개념을 미국의 형법 시스템이 채택하고 있는 정당성 및 면책사유에 관한 방어 이론을 체계적으로 적용하는데 필요한 분명한 원칙임을 이해하여야 한다. 제5장에서는 기본적 인권보장을 위하여 법적권리뿐만 아니라 윤리ㆍ도덕적 권리가 보호되어야 하고 그것을 인정하는 사례로 정당방어의 규정들인 미국의 ‘스탠드 유어 그라운드’(Stand Your Ground)’와 ‘캐슬 독트린(castle doctrine)’이라고 할 수 있는데 이 규정들은 수정헌법 “제2조 [국민의 무장권]와 법의 지배원리(The Principle of Rule of the Law)에에서 그 근거를 찾을 수 있다.
Abstract
It can be said that the words that acknowledge justice in the criminal law based on the Second Amendment to the US Constitution are ‘Justification and Excuse.’If the criminal law secured its justice from the Preamble and the Second Amendment, we have to consider what is the legal source of the Second Amendment. We believe that it can be traced back to Albert Dicey's ‘The Principle of the Rule of Law’ and Criminal Law's historical evidence. Chapter 2 is on the Second Amendment to the US Constitution and an overview of the Principle of the Rule of Law. In Chapter 3 we attempt to find some grounds for Justification and Excuse in the ancient laws. We also examine legal norms that imply justification and excuse as evidenced in the ancient criminal laws, or social norms. Chapter 4 is an overview of the concept of Justification. In Chapter 5 we study the protection of the legal as well as moral and ethical rights to ensure basic human rights. together with ‘Stand Your Ground’ and ‘Castle Doctrine,’ the two cases often quoted in support of self-defense.
