중국 경쟁법 집행강화와 산업정책

초록
최근 중국 경쟁법이 글로벌 시장에서 중국 대기업을 육성하기 위한 산업정책적 측면에서 집행되고 있다는 비판이 제기되고 있다. 중국은 한국의 대기업집단 성공을 부러워해 왔다. 그러나 외국 경제단체들에서는 경쟁법의 고유기능인 경쟁정책보다 산업정책 측면에서 경쟁법이 활용되고 있는 것을 우려하고 있다. 이러한 정책으로 인해 외국기업들이 중국 국내기업들에 비해 차별을 받을 수 있기 때문이다. 미 상공회의소는 중국 경쟁법상 조치들이 산업정책을 촉진시키고 중국 글로벌 대기업 육성을 위해 활용되고 있다고 우려하고 있다. 특히 기업결합심사가 중국 국내기업들을 지원하기 위한 수단으로 활용되는 측면, 지적재산권행사를 제한하기 위해 경쟁법이 사용되고 있다는 측면, 경쟁법 집행절차에서 독립성과 투명성이 부족하다는 측면 등에 대해 많은 우려가 제기되고 있다. 중국 경쟁법이 자국의 대기업을 육성하기 위한 방법으로 활용되고 있다는 비판과는 상반되게 한국에서는 오히려 경제력집중을 억제한다는 목적으로 대기업집단을 획일적으로 규제하는데 경쟁법이 활용되고 있다는 우려가 제기되어 왔다. 그러나 경쟁법의 역할은 대기업집단을 육성하기 위한 것도, 대기업집단을 규제하기 위한 것도 아니다. 경쟁법은 경쟁을 촉진시키기 위한 법이다. 이것이 경쟁법의 글로벌 기준이고 중국과 한국의 경쟁법도 이러한 기준에 한 걸음 더 다가갈 수 있도록 해야 할 것이다.
Abstract
Lately China’s Antimonopoly Law(AML) appear as an method of industrial policy of building globally competitive business groups. China has been trying to follow the success of Korean business group. However business community is expressing concern with China’s enforcement of the AML which set industrial policy above competition policy. Many western academic and practitioners have pointed out that the AML discriminate against foreign companies. The U.S. Chamber of Commerce state that AML remedies often appear designed to advance industrial policy and boost national champions. Merger review, which seems designed to support domestic industries; the use of competition law to constrain the exercise of intellectual property rights; and systemic flaws in the judicial system, including lack of independence and transparency. While China has used competition law as industrial policy of nurturing competitive business group, Korea has used it as an instrumental to regulate business group for inhibition economic power concentration. However Competition law’s role is not to nurture or regulate competitor(business group) but to encourage competition. That is the international norm and best practices of competition law.
