판례분석을 통해 본 아동청소년 인권과 체벌연구

초록
본 연구는 아동⋅청소년의 권리보호를 위해 체벌과 관련된 판례를 살펴판례가 제시하고자 하는 점이 무엇이며, 각 판례들의 보완점이 무엇인지를UN아동권리협약과 비교하여 살펴봄으로서 앞으로 아동⋅청소년의 인권을위한 사법부의 노력과 체벌에 대한 개선방향을 모색해 보는데 그 목적이있다. 이를 위해 헌법재판소결정을 비교 분석하면서 대법원판결을 비교 분석하여 사회복지 함의를 도출하고자 하였다. 자료 분석된 판례는 헌법재판소결정의 경우 체벌과 관련하여 청구인에게 다른 결정을 내린 두 개의 결정을 비교 분석하였으며, 대법원판결은 교사의 체벌과 관련한 허용범위를살펴본 판례를 비교 분석하였다. 본 연구의 판례 분석의 내용 분석을 위해법률적 해석방법론 중 목적적⋅객관적 해석방법론을 따라 판결에 대한 내용분석을 하면서 사회 복지적 함의를 찾고자 하였다. 본 연구는 아동⋅청소년의 인권보호를 위한 학생인권조례가 단지 형식에 지나지 않고 체벌의 전면적 금지가 사회전반에 뿌리내릴 수 있도록 법률해석을 통한 입법적 정책방안은 무엇이 있는지 살펴봄에 그 의미가 있다.
Abstract
This study is to examine past rulings related to corporal punishment on childrenand youth and compare those to UN Convention on the Right of the Child in orderto seek efforts and improvements made by the judical courts to protect the rights ofchildren and youth. For this purpose, the author has attempted to deduce socialwelfare implications by comparing and contrasting Constitutional Court and SupremeCourt rulings. Two of the Constitutional Court. rulings related to punishment, where different rulings have resulted, and SupremeCourt rulings that examined the tolerance band of teachers’ punishment werecompared and analyzed. In terms of the methodology used for legal interpretation,purposive⋅objective interpretation methods were utilized to draw the conclusion ofthis study to find social welfare implications. The findings from this study suggeststhat student rights ordinance to protect the rights of children and youth is nothing buta formality. We also examine possible legislative policies through legal interpretationto strengthen the basis of the total ban on punishments in the society at large.
