이 글은 구한말의 재판소구성법의 공포(1895)에서 로스쿨제도의 제안(1995)에 이르는 기간 동안 식민지 조선과 대한민국에서 전개되어 온 법조인양성제도의 역사를 조감하기 위한 것이다. ‘법조인’이란 국가의 사법제도 운영에 전면적으로 참여할 수 있는 자격자들(판검사, 변호사)을 말하지만, 시대 상황에 따라 그 범위가 변동한다. 이 글은 사법 근대화의 다섯 전선을 ‘인치 대 법치’, ‘관 대 민’, ‘행정 대 사법’, ‘시험 대 교육’, ‘비상 대 일상’의 다섯 전선을 제시한 뒤, 그 각각에서 벌어지는 전환이자 이행의 문제를 중심으로 한국 법조인양성제도의 역사를 살펴본다. 구한말의 사법 근대화 노력이 수포로 돌아간 것에서 출발하여, 식민지 시대의 왜곡된 법조인양성제도와 해방공간의 혼란을 거쳐 고등고시체제가 형성되는 것을 살핀 뒤, 1960년대 초에 시작된 사법시험체제의 변화가 결국 로스쿨체제로 이어지게 되는 맥락을 분석해보려는 것이다. 이와 같은 전환과 이행의 과정에서 법조사회의 구성원들이 언제나 지지하고 성원하는 태도를 보였던 것은 아니다. 구한말 대한제국기의 권신(權臣)들이 만연히 복고주의에 빠졌던 것이나, 해방공간의 조선인 법조인들이 난데없는 출세를 법률가수호주의로 방어했던 것이나, 군사정권기 이후 대한민국 법조인들이 엄선주의의 혜택에 탐닉했던 것은 대표적인 예이다. 그렇다면 법조인들의 이와 같은 안주와 외면에도 불구하고 한국 법조인양성제도의 역사에서 전환과 이행이 꾸준히 진행될 수 있었던 것은 무엇 때문일까? 이 글은 사법 근대화를 추진하는 주체에 있어서 외세로부터 자주에로, 또한 국가로부터 시민에로, 근본적인 전환과 이행이 이루어지고 있음을 주장한다.
Abstract
This paper is to review the historical changes of Korean legal education and lawyer licensing system from 1895-1995. The author analyses this 100 years long history with the concept of judicial modernization, which implies a kind of multiple transitions in between five overlapping political and institutional frontiers in Korean society; “rule of man vs. rule of law”, “state vs. people”, “administration vs. judiciary”, “examination vs. education”, “emergency situation vs. normal situation”. The periodization is very much like the one of ordinary Korean modern history; pre-colonization(1895-1910), colonization (1910-1945), initial formation(1945-1962), institutionalization(1962-1995), reformation(1995-present). Even though some Korean lawyers had been against those transitions in some historical periods, generally speaking, it is very true that great transitions have happened in those five frontiers. The author concludes that the most impressive transition is surely the change of the subject of judicial reform from the state to the people, who are sometimes represented by certain sub-groups of Korean lawyers society.
